66 relating to accepting an early voting ballot voted by mail;
77 creating a criminal offense.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 87, Election Code, is
1010 amended by adding Section 87.0412 to read as follows:
1111 Sec. 87.0412. SUSPENSION OF ACCEPTING VOTER REQUIREMENTS
1212 PROHIBITED. (a) A county clerk, elections administrator, early
1313 voting clerk, or early voting ballot board may not suspend the
1414 requirements under Section 87.041(b).
1515 (b) A county clerk, elections administrator, or early
1616 voting clerk who violates this section commits an offense. An
1717 offense under this section is a Class A misdemeanor.
1818 SECTION 2. The change in law made by this Act applies only
1919 to an offense committed on or after the effective date of this Act.
2020 An offense committed before the effective date of this Act is
2121 governed by the law in effect on the date the offense was committed,
2222 and the former law is continued in effect for that purpose. For
2323 purposes of this section, an offense was committed before the
2424 effective date of this Act if any element of the offense occurred
2525 before that date.
2626 SECTION 3. This Act takes effect September 1, 2023.
