55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the essential knowledge and skills of the public school
88 foundational curriculum for civics education and social studies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 28.002(h-1) and (h-2), Education Code,
1111 are amended to read as follows:
1212 (h-1) In adopting the essential knowledge and skills for the
1313 foundation curriculum under Subsection (a)(1), the State Board of
1414 Education shall, as appropriate, adopt essential knowledge and
1515 skills that develop each student's civic knowledge, including an
1616 understanding of:
1717 (1) the fundamental moral, political, and
1818 intellectual foundations of the American experiment in
1919 self-government;
2020 (2) the history, qualities, traditions, and features
2121 of civic engagement in the United States;
2222 (3) the structure, organization, function, and
2323 processes of government institutions at the federal, state, and
2424 local levels; and
2525 (4) the founding documents of the United States,
2626 including:
2727 (A) the entirety of the Declaration of
2828 Independence;
2929 (B) the entirety of the United States
3030 Constitution;
3131 (C) the Federalist Papers, including the
3232 entirety of Essays 10 [and] 51, and 78;
3333 (D) excerpts from Marbury v. Madison, 5 U.S. 137
3434 (1803);
3535 (E) excerpts from Alexis de Tocqueville's
3636 Democracy in America;
3737 (F) [(E)] the transcript of the first
3838 Lincoln-Douglas debate;
3939 (G) [(F)] the writings of the founding fathers of
4040 the United States;
4141 (H) [(G)] the entirety of Frederick Douglass's
4242 speeches "The Meaning of July Fourth for the Negro" and "What the
4343 Black Man Wants"; and
4444 (I) [(H)] the entirety of Martin Luther King
4545 Jr.'s speech "I Have a Dream."
4646 (h-2) In adopting the essential knowledge and skills for the
4747 social studies curriculum for each grade level from kindergarten
4848 through grade 12, the State Board of Education shall adopt
4949 essential knowledge and skills that develop each student's civic
5050 knowledge, including:
5151 (1) an understanding of:
5252 (A) the fundamental moral, political,
5353 entrepreneurial, and intellectual foundations of the American
5454 experiment in self-government;
5555 (B) the history, qualities, traditions, and
5656 features of civic engagement in the United States;
5757 (C) the structure, organization, function, and
5858 processes of government institutions at the federal, state, and
5959 local levels, with an emphasis on:
6060 (i) the structure of the federal court
6161 system and the court system of this state;
6262 (ii) the role the judiciary, as a co-equal
6363 branch of government, plays in providing checks and balances on
6464 governmental power;
6565 (iii) the selection of judicial
6666 officeholders within the federal and state judicial systems, with
6767 special consideration given to state and local officeholders of
6868 this state;
6969 (iv) the processing and flow of cases at all
7070 court levels in this state;
7171 (v) the role judges and juries play in the
7272 criminal and civil justice systems; and
7373 (vi) the sharing of governance between the
7474 federal and state governments in a federalist system and the
7575 interplay between the judicial examination of legal issues at the
7676 federal and state level; and
7777 (D) the founding documents of the United States;
7878 (2) the ability to:
7979 (A) analyze and determine the reliability of
8080 information sources;
8181 (B) formulate and articulate reasoned positions;
8282 (C) understand the manner in which local, state,
8383 and federal government works and operates through the use of
8484 simulations and models of governmental and democratic processes;
8585 (D) actively listen and engage in civil
8686 discourse, including discourse with those with different
8787 viewpoints; and
8888 (E) participate as a citizen in a constitutional
8989 democracy by voting; and
9090 (3) an appreciation of:
9191 (A) the importance and responsibility of
9292 participating in civic life;
9393 (B) a commitment to the United States and its
9494 form of government; and
9595 (C) a commitment to free speech and civil
9696 discourse.
9797 SECTION 2. This Act applies beginning with the 2023-2024
9898 school year.
9999 SECTION 3. This Act takes effect immediately if it receives
100100 a vote of two-thirds of all the members elected to each house, as
101101 provided by Section 39, Article III, Texas Constitution. If this
102102 Act does not receive the vote necessary for immediate effect, this
103103 Act takes effect September 1, 2023.
