66 AN ACT
77 relating to the authority of a physician to supervise or delegate
88 the prescribing or ordering of a drug or device to a physician
99 assistant or advanced practice registered nurse.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 157.0511, Occupations Code, is amended
1212 by adding Subsection (d) to read as follows:
1313 (d) A physician may not supervise or delegate the
1414 prescribing or ordering of a drug or device under this subchapter to
1515 a physician assistant or advanced practice registered nurse who
1616 practices in a medical specialty outside the scope of the
1717 physician's residency training or primary medical practice, unless
1818 the physician has not less than five years of previous practice
1919 experience in that specialty.
2020 SECTION 2. This Act takes effect September 1, 2023.
