66 AN ACT
77 relating to criminal liability for taking a weapon from a juvenile
88 probation officer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 17.03(b-3)(2), Code of Criminal
1111 Procedure, is amended to read as follows:
1212 (2) "Offense involving violence" means an offense
1313 under the following provisions of the Penal Code:
1414 (A) Section 19.02 (murder);
1515 (B) Section 19.03 (capital murder);
1616 (C) Section 20.03 (kidnapping);
1717 (D) Section 20.04 (aggravated kidnapping);
1818 (E) Section 20A.02 (trafficking of persons);
1919 (F) Section 20A.03 (continuous trafficking of
2020 persons);
2121 (G) Section 21.02 (continuous sexual abuse of
2222 young child or disabled individual);
2323 (H) Section 21.11 (indecency with a child);
2424 (I) Section 22.01(a)(1) (assault), if the
2525 offense is:
2626 (i) punishable as a felony of the second
2727 degree under Subsection (b-2) of that section; or
2828 (ii) punishable as a felony and involved
2929 family violence as defined by Section 71.004, Family Code;
3030 (J) Section 22.011 (sexual assault);
3131 (K) Section 22.02 (aggravated assault);
3232 (L) Section 22.021 (aggravated sexual assault);
3333 (M) Section 22.04 (injury to a child, elderly
3434 individual, or disabled individual);
3535 (N) Section 25.072 (repeated violation of
3636 certain court orders or conditions of bond in family violence,
3737 child abuse or neglect, sexual assault or abuse, indecent assault,
3838 stalking, or trafficking case);
3939 (O) Section 25.11 (continuous violence against
4040 the family);
4141 (P) Section 29.03 (aggravated robbery);
4242 (Q) Section 38.14 (taking or attempting to take
4343 weapon from certain individuals working in public safety [peace
4444 officer, federal special investigator, employee or official of
4545 correctional facility, parole officer, community supervision and
4646 corrections department officer, or commissioned security
4747 officer]);
4848 (R) Section 43.04 (aggravated promotion of
4949 prostitution), if the defendant is not alleged to have engaged in
5050 conduct constituting an offense under Section 43.02(a);
5151 (S) Section 43.05 (compelling prostitution); or
5252 (T) Section 43.25 (sexual performance by a
5353 child).
5454 SECTION 2. The heading to Section 38.14, Penal Code, is
5555 amended to read as follows:
5656 Sec. 38.14. TAKING OR ATTEMPTING TO TAKE WEAPON FROM
5757 CERTAIN INDIVIDUALS WORKING IN PUBLIC SAFETY [PEACE OFFICER,
5858 FEDERAL SPECIAL INVESTIGATOR, EMPLOYEE OR OFFICIAL OF CORRECTIONAL
5959 FACILITY, PAROLE OFFICER, COMMUNITY SUPERVISION AND CORRECTIONS
6060 DEPARTMENT OFFICER, OR COMMISSIONED SECURITY OFFICER].
6161 SECTION 3. Sections 38.14(b), (c), and (d), Penal Code, are
6262 amended to read as follows:
6363 (b) A person commits an offense if the person intentionally
6464 or knowingly and with force takes or attempts to take from a peace
6565 officer, federal special investigator, employee or official of a
6666 correctional facility, parole officer, community supervision and
6767 corrections department officer, juvenile probation officer, or
6868 commissioned security officer the officer's, investigator's,
6969 employee's, or official's firearm, nightstick, stun gun, or
7070 personal protection chemical dispensing device.
7171 (c) The actor is presumed to have known that the peace
7272 officer, federal special investigator, employee or official of a
7373 correctional facility, parole officer, community supervision and
7474 corrections department officer, juvenile probation officer, or
7575 commissioned security officer was a peace officer, federal special
7676 investigator, employee or official of a correctional facility,
7777 parole officer, community supervision and corrections department
7878 officer, juvenile probation officer, or commissioned security
7979 officer if:
8080 (1) the officer, investigator, employee, or official
8181 was wearing a distinctive uniform or badge indicating his
8282 employment; or
8383 (2) the officer, investigator, employee, or official
8484 identified himself as a peace officer, federal special
8585 investigator, employee or official of a correctional facility,
8686 parole officer, community supervision and corrections department
8787 officer, juvenile probation officer, or commissioned security
8888 officer.
8989 (d) It is a defense to prosecution under this section that
9090 the defendant took or attempted to take the weapon from a peace
9191 officer, federal special investigator, employee or official of a
9292 correctional facility, parole officer, community supervision and
9393 corrections department officer, juvenile probation officer, or
9494 commissioned security officer who was using force against the
9595 defendant or another in excess of the amount of force permitted by
9696 law.
9797 SECTION 4. The change in law made by this Act applies only
9898 to an offense committed on or after the effective date of this
9999 Act. An offense committed before the effective date of this Act is
100100 governed by the law in effect on the date the offense was committed,
101101 and the former law is continued in effect for that purpose. For
102102 purposes of this section, an offense was committed before the
103103 effective date of this Act if any element of the offense occurred
104104 before that date.
105105 SECTION 5. This Act takes effect September 1, 2023.
