88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 86, Education Code, is
1010 amended by adding Section 86.531 to read as follows:
1111 Sec. 86.531. ANNUAL STUDY AND REPORT ON SINGLE-FAMILY HOME
1212 PURCHASES AND SALES BY CERTAIN INSTITUTIONAL BUYERS. (a) In this
1313 section, "institutional buyer" means a corporation, limited or
1414 general partnership, limited liability company, business trust,
1515 investment asset manager, real estate investment trust, joint
1616 venture, joint stock company, or bank that purchases or acquires
1717 for consideration 10 or more single-family homes in this state in a
1818 calendar year.
1919 (b) Using existing available data and deed records, the
2020 center shall annually compile information related to institutional
2121 buyers' purchases and sales of single-family homes in this state
2222 for the calendar year. The information must include:
2323 (1) the number of single-family homes purchased by
2424 each institutional buyer in the calendar year;
2525 (2) of the single-family homes described by
2626 Subdivision (1), the number acquired through foreclosure;
2727 (3) of the single-family homes described by
2828 Subdivision (1), the number sold by each institutional buyer during
2929 the same year;
3030 (4) of the single-family homes described by
3131 Subdivision (1), the number used as rental properties during the
3232 same year;
3333 (5) the city and county where each single-family home
3434 described by Subdivision (1) is located and the number of homes
3535 purchased in each city or county; and
3636 (6) the appraised value of each single-family home
3737 described by Subdivision (1).
3838 (c) In addition to the information required by Subsection
3939 (b), the center may compile additional information:
4040 (1) at the recommendation of the legislature; or
4141 (2) that the center determines is relevant based on
4242 market trends.
4343 (d) Not later than June 1 of each year, the center shall
4444 submit a report to the lieutenant governor, the speaker of the house
4545 of representatives, and each member of the legislature. The report
4646 must contain:
4747 (1) a summary of the information compiled under
4848 Subsection (b) for the preceding calendar year;
4949 (2) an assessment of any trends or patterns relating
5050 to the relative number of purchases by institutional buyers,
5151 including whether the institutional buyers fall into any readily
5252 observable groups based on number of purchases or other appropriate
5353 criteria; and
5454 (3) an analysis of:
5555 (A) the impact of institutional buyers on the
5656 cost of housing; and
5757 (B) the advantages, if any, that institutional
5858 buyers have over individual buyers in the real estate market.
5959 (e) After completing the initial report under this section,
6060 the center may compile information from any calendar years
6161 preceding 2023 to create and submit reports for those years that
6262 include the information listed in Subsections (b) and (d).
6363 SECTION 2. As soon as practicable after the effective date
6464 of this Act, the Texas A&M University Texas Real Estate Research
6565 Center shall take any actions necessary to prepare to implement
6666 Section 86.531, Education Code, as added by this Act, and submit the
6767 initial report required under Section 86.531(d), Education Code, as
6868 added by this Act, not later than June 1, 2024.
6969 SECTION 3. This Act takes effect September 1, 2023.
