| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 49.057, Water Code, is amended by |
|---|
| 10 | 10 | | amending Subsection (d) and adding Subsection (d-1) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (d) The [In selecting attorneys, engineers, auditors, |
|---|
| 13 | 13 | | financial advisors, or other professional consultants, the] |
|---|
| 14 | 14 | | district shall follow the procedures provided in Subchapter A, |
|---|
| 15 | 15 | | Chapter 2254, Government Code (Professional Services Procurement |
|---|
| 16 | 16 | | Act), when selecting a provider of professional services. |
|---|
| 17 | 17 | | (d-1) For purposes of this section, "provider of |
|---|
| 18 | 18 | | professional services" includes: |
|---|
| 19 | 19 | | (1) a provider of professional services described by |
|---|
| 20 | 20 | | Section 2254.002(2)(B), Government Code; |
|---|
| 21 | 21 | | (2) an attorney; |
|---|
| 22 | 22 | | (3) an auditor; or |
|---|
| 23 | 23 | | (4) a financial advisor. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
