55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the commissioning of peace officers by certain
88 parochial schools in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 37, Education Code, is
1111 amended by adding Section 37.0818 to read as follows:
1212 Sec. 37.0818. PAROCHIAL SCHOOL PEACE OFFICERS. (a) In this
1313 section, "parochial school" means a private school that is operated
1414 by a religious organization and provides students with religious
1515 instruction as part of the school's curriculum.
1616 (b) This section applies only to a parochial school that is:
1717 (1) located in a county with a population of 3.3
1818 million or more; and
1919 (2) operated by a religious organization with at least
2020 50,000 members.
2121 (c) The governing body of a parochial school to which this
2222 section applies may commission peace officers to enforce state and
2323 local law on a campus of the school.
2424 (d) The duties of a peace officer commissioned by a
2525 parochial school under this section shall include protecting:
2626 (1) the safety and welfare of any person in the
2727 jurisdiction of the officer; and
2828 (2) the property of the school.
2929 (e) A peace officer commissioned by a parochial school under
3030 this section must meet all minimum standards for peace officers
3131 established by the Texas Commission on Law Enforcement.
3232 SECTION 2. Article 2.12, Code of Criminal Procedure, is
3333 amended to read as follows:
3434 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
3535 officers:
3636 (1) sheriffs, their deputies, and those reserve
3737 deputies who hold a permanent peace officer license issued under
3838 Chapter 1701, Occupations Code;
3939 (2) constables, deputy constables, and those reserve
4040 deputy constables who hold a permanent peace officer license issued
4141 under Chapter 1701, Occupations Code;
4242 (3) marshals or police officers of an incorporated
4343 city, town, or village, and those reserve municipal police officers
4444 who hold a permanent peace officer license issued under Chapter
4545 1701, Occupations Code;
4646 (4) rangers, officers, and members of the reserve
4747 officer corps commissioned by the Public Safety Commission and the
4848 Director of the Department of Public Safety;
4949 (5) investigators of the district attorneys', criminal
5050 district attorneys', and county attorneys' offices;
5151 (6) law enforcement agents of the Texas Alcoholic
5252 Beverage Commission;
5353 (7) each member of an arson investigating unit
5454 commissioned by a city, a county, or the state;
5555 (8) officers commissioned under Section 37.081 or
5656 37.0818, Education Code, or Subchapter E, Chapter 51, Education
5757 Code;
5858 (9) officers commissioned by the General Services
5959 Commission;
6060 (10) law enforcement officers commissioned by the
6161 Parks and Wildlife Commission;
6262 (11) officers commissioned under Chapter 23,
6363 Transportation Code;
6464 (12) municipal park and recreational patrolmen and
6565 security officers;
6666 (13) security officers and investigators commissioned
6767 as peace officers by the comptroller;
6868 (14) officers commissioned by a water control and
6969 improvement district under Section 49.216, Water Code;
7070 (15) officers commissioned by a board of trustees
7171 under Chapter 54, Transportation Code;
7272 (16) investigators commissioned by the Texas Medical
7373 Board;
7474 (17) officers commissioned by:
7575 (A) the board of managers of the Dallas County
7676 Hospital District, the Tarrant County Hospital District, the Bexar
7777 County Hospital District, or the El Paso County Hospital District
7878 under Section 281.057, Health and Safety Code;
7979 (B) the board of directors of the Ector County
8080 Hospital District under Section 1024.117, Special District Local
8181 Laws Code;
8282 (C) the board of directors of the Midland County
8383 Hospital District of Midland County, Texas, under Section 1061.121,
8484 Special District Local Laws Code; and
8585 (D) the board of hospital managers of the Lubbock
8686 County Hospital District of Lubbock County, Texas, under Section
8787 1053.113, Special District Local Laws Code;
8888 (18) county park rangers commissioned under
8989 Subchapter E, Chapter 351, Local Government Code;
9090 (19) investigators employed by the Texas Racing
9191 Commission;
9292 (20) officers commissioned under Chapter 554,
9393 Occupations Code;
9494 (21) officers commissioned by the governing body of a
9595 metropolitan rapid transit authority under Section 451.108,
9696 Transportation Code, or by a regional transportation authority
9797 under Section 452.110, Transportation Code;
9898 (22) investigators commissioned by the attorney
9999 general under Section 402.009, Government Code;
100100 (23) security officers and investigators commissioned
101101 as peace officers under Chapter 466, Government Code;
102102 (24) officers appointed by an appellate court under
103103 Subchapter F, Chapter 53, Government Code;
104104 (25) officers commissioned by the state fire marshal
105105 under Chapter 417, Government Code;
106106 (26) an investigator commissioned by the commissioner
107107 of insurance under Section 701.104, Insurance Code;
108108 (27) apprehension specialists and inspectors general
109109 commissioned by the Texas Juvenile Justice Department as officers
110110 under Sections 242.102 and 243.052, Human Resources Code;
111111 (28) officers appointed by the inspector general of
112112 the Texas Department of Criminal Justice under Section 493.019,
113113 Government Code;
114114 (29) investigators commissioned by the Texas
115115 Commission on Law Enforcement under Section 1701.160, Occupations
116116 Code;
117117 (30) commission investigators commissioned by the
118118 Texas Private Security Board under Section 1702.061, Occupations
119119 Code;
120120 (31) the fire marshal and any officers, inspectors, or
121121 investigators commissioned by an emergency services district under
122122 Chapter 775, Health and Safety Code;
123123 (32) officers commissioned by the State Board of
124124 Dental Examiners under Section 254.013, Occupations Code, subject
125125 to the limitations imposed by that section;
126126 (33) investigators commissioned by the Texas Juvenile
127127 Justice Department as officers under Section 221.011, Human
128128 Resources Code; and
129129 (34) the fire marshal and any related officers,
130130 inspectors, or investigators commissioned by a county under
131131 Subchapter B, Chapter 352, Local Government Code.
132132 SECTION 3. This Act takes effect September 1, 2023.
