55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a limitation on the generation capacity provided for
88 the ERCOT power grid from wind and solar generation facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.159, Utilities Code, as added by
1111 Chapter 426 (S.B. 3), Acts of the 87th Legislature, Regular
1212 Session, 2021, is amended by amending Subsection (b) and adding
1313 Subsection (d) to read as follows:
1414 (b) The commission shall ensure that the independent
1515 organization certified under Section 39.151 for the ERCOT power
1616 region:
1717 (1) subject to Subsection (d), establishes
1818 requirements to meet the reliability needs of the power region;
1919 (2) periodically, but at least annually, determines
2020 the quantity and characteristics of ancillary or reliability
2121 services necessary to ensure appropriate reliability during
2222 extreme heat and extreme cold weather conditions and during times
2323 of low non-dispatchable power production in the power region;
2424 (3) procures ancillary or reliability services on a
2525 competitive basis to ensure appropriate reliability during extreme
2626 heat and extreme cold weather conditions and during times of low
2727 non-dispatchable power production in the power region;
2828 (4) develops appropriate qualification and
2929 performance requirements for providing services under Subdivision
3030 (3), including appropriate penalties for failure to provide the
3131 services; and
3232 (5) sizes the services procured under Subdivision (3)
3333 to prevent prolonged rotating outages due to net load variability
3434 in high demand and low supply scenarios.
3535 (d) Beginning January 1, 2027, notwithstanding any other
3636 law, if the commission determines that installed generation
3737 capacity from wind and solar generation facilities is contributing
3838 more than 20 percent of the available generation capacity for the
3939 ERCOT power region, the commission shall:
4040 (1) prohibit the interconnection of new wind and solar
4141 generation facilities to the power grid; and
4242 (2) by rule establish standards for the disconnection
4343 of wind and solar power facilities from the power grid to ensure
4444 that wind and solar generation is not contributing more than 20
4545 percent of the available generation capacity for the ERCOT power
4646 region at any time.
4747 SECTION 2. This Act takes effect September 1, 2023.
