44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to prohibiting an increase in the rent before the end of a
77 lease term of a tenant residing in a development supported with a
88 low income housing tax credit allocation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2306.6738(a), Government Code, is
1111 amended to read as follows:
1212 (a) Notwithstanding any other law, a development owner of a
1313 development supported with a housing tax credit allocation may not:
1414 (1) lock out or threaten to lock out any person
1515 residing in the development except by judicial process unless the
1616 exclusion results from:
1717 (A) a necessity to perform bona fide repairs or
1818 construction work; or
1919 (B) an emergency; [or]
2020 (2) seize or threaten to seize the personal property
2121 of any person residing in the development except by judicial
2222 process unless the resident has abandoned the premises; or
2323 (3) except as provided under the terms of a voucher
2424 program under Section 8, United States Housing Act of 1937 (42
2525 U.S.C. Section 1437f), or a similar rental subsidy program,
2626 increase the rent paid by a person residing in the development
2727 during the duration of the person's lease agreement.
2828 SECTION 2. Section 2306.6738, Government Code, as amended
2929 by this Act, applies to a lease agreement entered into or renewed on
3030 or after the effective date of this Act.
3131 SECTION 3. This Act takes effect September 1, 2023.
