| 7 | 7 | | relating to the registration, ownership, and operation of certain |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 502.143, Transportation Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | Sec. 502.143. OTHER VEHICLES. (a) An owner may not register |
|---|
| 13 | 13 | | the following vehicles for operation on a public highway: |
|---|
| 14 | 14 | | (1) power sweepers; |
|---|
| 15 | 15 | | (2) motorized mobility devices; |
|---|
| 16 | 16 | | (3) electric personal assistive mobility devices; |
|---|
| 17 | 17 | | [and] |
|---|
| 18 | 18 | | (4) electric bicycles, as defined by Section 664.001; |
|---|
| 19 | 19 | | and |
|---|
| 20 | 20 | | (5) motor vehicles that are equipped with remote |
|---|
| 21 | 21 | | vehicle disabling technology. |
|---|
| 22 | 22 | | (b) For purposes of Subsection (a)(5), "remote vehicle |
|---|
| 23 | 23 | | disabling technology" means any application or device, including |
|---|
| 24 | 24 | | software, firmware, and hardware, that, when activated or engaged, |
|---|
| 25 | 25 | | allows a person to disable the operation of a motor vehicle. The |
|---|
| 26 | 26 | | term does not include an ignition interlock device as defined by |
|---|
| 27 | 27 | | Article 42A.408, Code of Criminal Procedure. |
|---|
| 28 | 28 | | SECTION 2. Subchapter E, Chapter 542, Transportation Code, |
|---|
| 29 | 29 | | is amended by adding Section 542.502 to read as follows: |
|---|
| 30 | 30 | | Sec. 542.502. MOTOR VEHICLE POWERED BY INTERNAL COMBUSTION |
|---|
| 31 | 31 | | ENGINE; OPERATION OF VEHICLE USING HUMAN DECISION-MAKING. A person |
|---|
| 32 | 32 | | may not be prohibited from owning a motor vehicle that is powered by |
|---|
| 33 | 33 | | an internal combustion engine or from operating that vehicle using |
|---|
| 34 | 34 | | human decision-making, regardless of any other law or regulation |
|---|
| 35 | 35 | | requiring a motor vehicle to be equipped with or operated using an |
|---|
| 36 | 36 | | automated driving system, as defined by Section 545.451. |

| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2023. |
