55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the registration, ownership, and operation of certain
88 motor vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 502.143, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 502.143. OTHER VEHICLES. (a) An owner may not register
1313 the following vehicles for operation on a public highway:
1414 (1) power sweepers;
1515 (2) motorized mobility devices;
1616 (3) electric personal assistive mobility devices;
1717 [and]
1818 (4) electric bicycles, as defined by Section 664.001;
1919 and
2020 (5) motor vehicles that are equipped with remote
2121 vehicle disabling technology.
2222 (b) For purposes of Subsection (a)(5), "remote vehicle
2323 disabling technology" means any application or device, including
2424 software, firmware, and hardware, that, when activated or engaged,
2525 allows a person to disable the operation of a motor vehicle. The
2626 term does not include an ignition interlock device as defined by
2727 Article 42A.408, Code of Criminal Procedure.
2828 SECTION 2. Subchapter E, Chapter 542, Transportation Code,
2929 is amended by adding Section 542.502 to read as follows:
3030 Sec. 542.502. MOTOR VEHICLE POWERED BY INTERNAL COMBUSTION
3131 ENGINE; OPERATION OF VEHICLE USING HUMAN DECISION-MAKING. A person
3232 may not be prohibited from owning a motor vehicle that is powered by
3333 an internal combustion engine or from operating that vehicle using
3434 human decision-making, regardless of any other law or regulation
3535 requiring a motor vehicle to be equipped with or operated using an
3636 automated driving system, as defined by Section 545.451.
3737 SECTION 3. This Act takes effect September 1, 2023.
