55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the approval of beach access and use plans by the
88 commissioner of the General Land Office.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 61.015, Natural Resources Code, is
1111 amended by amending Subsection (b) and adding Subsections (b-1) and
1212 (b-2) to read as follows:
1313 (b) Local governments shall submit proposed beach access
1414 and use plans to the commissioner for certification as to
1515 compliance with such policies and rules. The commissioner shall
1616 act on a local government's proposed beach access and use plan
1717 within 90 days of submission by [either] approving the plan,
1818 partially approving the plan and identifying geographic areas of
1919 noncompliance, or denying certification.
2020 (b-1) In the event of a partial approval under Subsection
2121 (b), the local government may adopt rules and requirements for the
2222 portion of the plan that has been approved.
2323 (b-2) In the event of denial under Subsection (b), the
2424 commissioner shall send the proposed plan back to the originating
2525 local government with a statement of specific objections and the
2626 reasons for denial, along with suggested modifications. On
2727 receipt, the local government shall revise and resubmit the plan.
2828 The commissioner's certification of local government plans shall be
2929 by adoption into the rules under Section 61.011.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2023.
