66 relating to the administration of the Texas Innovative Adult Career
77 Education (ACE) Grant Program by the Texas Higher Education
88 Coordinating Board.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 136.001, Education Code, is amended by
1111 amending Subdivision (1) and adding Subdivision (1-a) to read as
1212 follows:
1313 (1) "Coordinating board" means the Texas Higher
1414 Education Coordinating Board.
1515 (1-a) "Nonprofit organization" means an organization
1616 exempt from federal income taxation under Section 501(a), Internal
1717 Revenue Code of 1986, as an organization described by Section
1818 501(c)(3) of that code.
1919 SECTION 2. Section 136.005(a), Education Code, is amended
2020 to read as follows:
2121 (a) The coordinating board [grant administrator] shall
2222 establish and administer the Texas Innovative Adult Career
2323 Education (ACE) Grant Program to provide grants to:
2424 (1) eligible nonprofit workforce intermediary and job
2525 training organizations; and
2626 (2) eligible nonprofit organizations providing job
2727 training to veterans.
2828 SECTION 3. Section 136.006, Education Code, is amended to
2929 read as follows:
3030 Sec. 136.006. ELIGIBLE ORGANIZATIONS. (a) To be eligible
3131 for a grant under the program, a nonprofit workforce intermediary
3232 and job training organization must:
3333 (1) apply to the coordinating board [grant
3434 administrator] in the manner prescribed by the coordinating board
3535 [grant administrator];
3636 (2) provide to eligible low-income students, in
3737 partnership with public junior colleges, public state colleges, or
3838 public technical institutes:
3939 (A) job training; and
4040 (B) a continuum of services designed to move a
4141 program participant from application to employment, including
4242 outreach, assessment, case management, support services, and
4343 career placement;
4444 (3) be governed by a board or other governing
4545 structure that includes recognized leaders of broad-based
4646 community organizations and executive-level or managerial-level
4747 members of the local business community;
4848 (4) demonstrate to the satisfaction of the
4949 coordinating board [program advisory board] that the
5050 organization's program has achieved or will achieve the following
5151 measures of success among program participants:
5252 (A) above-average completion of developmental
5353 education among participating public junior college, public state
5454 college, or public technical institute students;
5555 (B) above-average persistence rates among
5656 participating public junior college, public state college, or
5757 public technical institute students;
5858 (C) above-average certificate or degree
5959 completion rates by participating students within a three-year
6060 period compared to demographically comparable public junior
6161 college, public state college, and public technical institute
6262 students; and
6363 (D) entry into careers with significantly higher
6464 earnings for program participants than previously achieved; and
6565 (5) provide matching funds in accordance with rules
6666 adopted under this chapter.
6767 (a-1) To be eligible for a grant under the program, a
6868 nonprofit organization providing job training services to veterans
6969 must:
7070 (1) apply to the coordinating board [grant
7171 administrator] in the manner prescribed by the coordinating board
7272 [grant administrator];
7373 (2) provide to veterans, in partnership with public
7474 junior colleges, public state colleges, or public technical
7575 institutes:
7676 (A) job training; and
7777 (B) a continuum of services designed to move a
7878 program participant from application to employment, including
7979 outreach, assessment, case management, support services, and
8080 career placement;
8181 (3) be governed by a board or other governing
8282 structure that includes recognized leaders of broad-based
8383 community organizations and executive-level or managerial-level
8484 members of the local business community;
8585 (4) demonstrate to the satisfaction of the
8686 coordinating board [program advisory board] that the
8787 organization's program has achieved or will achieve the following
8888 measures of success among program participants:
8989 (A) the measures prescribed by Subsections
9090 (a)(4)(A)-(C);
9191 (B) rapid attainment of civilian workforce
9292 credentials; and
9393 (C) entry into careers with significantly higher
9494 earnings for program participants than previously achieved; and
9595 (5) provide matching funds in accordance with rules
9696 adopted under this chapter.
9797 (b) The matching funds required under Subsection (a)(5) or
9898 (a-1)(5) may be obtained from any source available to the
9999 organization, including in-kind contributions, community or
100100 foundation grants, individual contributions, and local
101101 governmental agency operating funds. The coordinating board [grant
102102 administrator] may adopt rules requiring an organization to
103103 demonstrate compliance with the matching funds requirement before
104104 the payment of the next installment under an awarded grant.
105105 SECTION 4. Section 136.007, Education Code, is amended to
106106 read as follows:
107107 Sec. 136.007. RULES. [(a)] The coordinating board [grant
108108 administrator] shall adopt rules as necessary for the
109109 administration of this chapter, including [in the manner provided
110110 by Chapter 2001, Government Code, for a state agency.
111111 [(b) The grant administrator, with recommendations of the
112112 program advisory board, shall adopt] rules regarding eligibility,
113113 program tuition and fees, administrative costs, matching funds, and
114114 case management and other supports for the program. The rules may
115115 include provisions for the payment in periodic installments of
116116 grant awards.
117117 SECTION 5. The following provisions of Chapter 136,
118118 Education Code, are repealed:
119119 (1) Sections 136.002 and 136.004; and
120120 (2) Section 136.005(a-1).
121121 SECTION 6. This Act takes effect September 1, 2023.
