77 relating to creating a mental health allotment under the Foundation
88 School Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 48, Education Code, is
1111 amended by adding Section 48.117 to read as follows:
1212 Sec. 48.117. MENTAL HEALTH ALLOTMENT. (a) In this section,
1313 "mental health services" means assessment, diagnosis, treatment,
1414 or counseling by a mental health professional to assist a student
1515 in:
1616 (1) alleviating mental or emotional illness,
1717 symptoms, conditions, or disorders, including alcohol or drug
1818 addiction;
1919 (2) understanding conscious or subconscious
2020 motivations;
2121 (3) resolving emotional, attitudinal, or relationship
2222 conflicts; or
2323 (4) modifying feelings, attitudes, or behaviors that
2424 interfere with effective emotional, social, or intellectual
2525 functioning.
2626 (b) This section applies only to a school district in which
2727 not less than 60 percent of the campuses in the district offer
2828 students access to mental health services.
2929 (c) From funds appropriated or otherwise available for the
3030 purpose, the commissioner may provide to a school district to which
3131 this section applies an annual allotment for each student who
3232 accesses mental health services through the district in an amount
3333 equal to the district's basic allotment or, if applicable, the sum
3434 of the basic allotment and the allotment under Section 48.101 to
3535 which the district is entitled, multiplied by a weight in an amount
3636 determined by the commissioner based on criteria related to the
3737 cost of providing those services.
3838 SECTION 2. This Act takes effect September 1, 2023.
