| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 48, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 48.117 to read as follows: |
|---|
| 12 | 12 | | Sec. 48.117. MENTAL HEALTH ALLOTMENT. (a) In this section, |
|---|
| 13 | 13 | | "mental health services" means assessment, diagnosis, treatment, |
|---|
| 14 | 14 | | or counseling by a mental health professional to assist a student |
|---|
| 15 | 15 | | in: |
|---|
| 16 | 16 | | (1) alleviating mental or emotional illness, |
|---|
| 17 | 17 | | symptoms, conditions, or disorders, including alcohol or drug |
|---|
| 18 | 18 | | addiction; |
|---|
| 19 | 19 | | (2) understanding conscious or subconscious |
|---|
| 20 | 20 | | motivations; |
|---|
| 21 | 21 | | (3) resolving emotional, attitudinal, or relationship |
|---|
| 22 | 22 | | conflicts; or |
|---|
| 23 | 23 | | (4) modifying feelings, attitudes, or behaviors that |
|---|
| 24 | 24 | | interfere with effective emotional, social, or intellectual |
|---|
| 25 | 25 | | functioning. |
|---|
| 26 | 26 | | (b) This section applies only to a school district in which |
|---|
| 27 | 27 | | not less than 60 percent of the campuses in the district offer |
|---|
| 28 | 28 | | students access to mental health services. |
|---|
| 29 | 29 | | (c) From funds appropriated or otherwise available for the |
|---|
| 30 | 30 | | purpose, the commissioner may provide to a school district to which |
|---|
| 31 | 31 | | this section applies an annual allotment for each student who |
|---|
| 32 | 32 | | accesses mental health services through the district in an amount |
|---|
| 33 | 33 | | equal to the district's basic allotment or, if applicable, the sum |
|---|
| 34 | 34 | | of the basic allotment and the allotment under Section 48.101 to |
|---|
| 35 | 35 | | which the district is entitled, multiplied by a weight in an amount |
|---|
| 36 | 36 | | determined by the commissioner based on criteria related to the |
|---|
| 37 | 37 | | cost of providing those services. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2023. |
