66 AN ACT
77 relating to repayment of certain mental health professional
88 education loans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 61.601, Education Code, as amended by
1111 Chapters 891 (H.B. 3083) and 1101 (H.B. 3808), Acts of the 85th
1212 Legislature, Regular Session, 2017, is reenacted and amended to
1313 read as follows:
1414 Sec. 61.601. DEFINITION. In this subchapter, "mental
1515 health professional" means:
1616 (1) a licensed physician who is:
1717 (A) a graduate of an accredited psychiatric
1818 residency training program; or
1919 (B) certified in psychiatry by:
2020 (i) the American Board of Psychiatry and
2121 Neurology; or
2222 (ii) the American Osteopathic Board of
2323 Neurology and Psychiatry;
2424 (2) a psychologist, as defined by Section 501.002,
2525 Occupations Code;
2626 (3) a licensed professional counselor, as defined by
2727 Section 503.002, Occupations Code;
2828 (4) an advanced practice registered nurse, as defined
2929 by Section 301.152, Occupations Code, who holds a nationally
3030 recognized board certification in psychiatric or mental health
3131 nursing;
3232 (5) a licensed clinical social worker, as defined by
3333 Section 505.002, Occupations Code; [and]
3434 (6) a licensed master social worker, as defined by
3535 Section 505.002, Occupations Code;
3636 (7) a person who holds a licensed professional
3737 counselor associate license issued by the Texas State Board of
3838 Examiners of Professional Counselors;
3939 (8) [(6)] a licensed marriage and family therapist, as
4040 defined by Section 502.002, Occupations Code; and
4141 (9) a chemical dependency counselor, as defined by
4242 Section 504.001, Occupations Code.
4343 SECTION 2. Section 61.607(b), Education Code, is amended to
4444 read as follows:
4545 (b) The total amount of repayment assistance received by a
4646 mental health professional under this subchapter may not exceed:
4747 (1) $160,000, for assistance from the state received
4848 by a licensed physician;
4949 (2) $80,000, for assistance from the state received
5050 by:
5151 (A) a psychologist;
5252 (B) a licensed clinical social worker, if the
5353 social worker has received a doctoral degree related to social
5454 work;
5555 (C) a licensed professional counselor, if the
5656 counselor has received a doctoral degree related to counseling; or
5757 (D) a licensed marriage and family therapist, if
5858 the marriage and family therapist has received a doctoral degree
5959 related to marriage and family therapy;
6060 (3) $60,000, for assistance from the state received by
6161 an advanced practice registered nurse;
6262 (4) $40,000, for assistance from the state received
6363 by:
6464 (A) a licensed clinical social worker, a licensed
6565 marriage and family therapist, or a licensed professional counselor
6666 who is not described by Subdivision (2);
6767 (B) a licensed master social worker; or
6868 (C) a person who holds a licensed professional
6969 counselor associate license issued by the Texas State Board of
7070 Examiners of Professional Counselors; and
7171 (5) $10,000, for assistance from the state received by
7272 a licensed chemical dependency counselor, if the chemical
7373 dependency counselor has received an associate degree related to
7474 chemical dependency counseling or behavioral science.
7575 SECTION 3. The following provisions are repealed:
7676 (1) Sections 61.604(d) and (e), Education Code, as
7777 added by Chapter 1101 (H.B. 3808), Acts of the 85th Legislature,
7878 Regular Session, 2017; and
7979 (2) Section 61.608(c), Education Code, as added by
8080 Chapter 1101 (H.B. 3808), Acts of the 85th Legislature, Regular
8181 Session, 2017.
8282 SECTION 4. This Act takes effect September 1, 2023.
