55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the process for recovering overpayments under Medicaid.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 531.1131(f), Government Code, is amended
1010 to read as follows:
1111 (f) In adopting rules establishing due process procedures
1212 under Subsection (e), the executive commissioner shall require that
1313 a managed care organization or an entity with which the managed care
1414 organization contracts under Section 531.113(a)(2) that engages in
1515 payment recovery efforts in accordance with this section and
1616 Section 531.1135 provide:
1717 (1) written notice to a provider required to use
1818 electronic visit verification of the organization's intent to
1919 recoup overpayments in accordance with Section 531.1135; and
2020 (2) any [a] provider [described by Subdivision (1)] at
2121 least 60 days after the provider has exhausted all rights to an
2222 appeal to cure any defect in a claim, including by submitting
2323 necessary documentation for the claim or resubmitting the claim,
2424 before the organization may begin any efforts to collect
2525 overpayments.
2626 SECTION 2. If before implementing any provision of this Act
2727 a state agency determines that a waiver or authorization from a
2828 federal agency is necessary for implementation of that provision,
2929 the agency affected by the provision shall request the waiver or
3030 authorization and may delay implementing that provision until the
3131 waiver or authorization is granted.
3232 SECTION 3. This Act takes effect September 1, 2023.
