55 relating to the operation and management of the Iwo Jima monument
66 and museum by the Texas Historical Commission.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 442, Government Code, is amended by
99 adding Subchapter B-2 to read as follows:
1010 SUBCHAPTER B-2. IWO JIMA MONUMENT AND MUSEUM
1111 Sec. 442.065. DEFINITION. In this subchapter, "monument
1212 and museum" means the Iwo Jima monument and museum at the Marine
1313 Military Academy in Harlingen, Texas.
1414 Sec. 442.066. IWO JIMA MONUMENT AND MUSEUM; FUND. (a) To
1515 the extent authorized by law, the commission may enter into a
1616 contract with the nonprofit entity that owns the monument and
1717 museum to transfer to the commission the operation and management
1818 of the monument and museum.
1919 (b) The contract authorized by this section must include
2020 provisions for:
2121 (1) expanding, renovating, managing, maintaining,
2222 operating, or providing financial support for the monument and
2323 museum, including administration, construction and operation of a
2424 visitor center, and related activities;
2525 (2) preserving military documents, relics, and other
2626 items of historical interest;
2727 (3) employing a museum director and other employees
2828 the commission considers necessary to fulfill its duties and
2929 responsibilities under the contract;
3030 (4) accepting donations of money, property, and
3131 historical relics; and
3232 (5) acquiring property and historical relics with
3333 funds available for that purpose.
3434 (c) The Iwo Jima monument and museum fund is created as a
3535 fund outside the state treasury. The commission shall administer
3636 the fund but may contract with the nonprofit entity that owns the
3737 monument and museum for administration of the fund. The fund
3838 consists of:
3939 (1) admissions revenue from the operation of the
4040 monument and museum;
4141 (2) sales revenue from the operation of the monument
4242 and museum gift shop; and
4343 (3) donations made to the commission for the monument
4444 and museum.
4545 (d) Money in the Iwo Jima monument and museum fund may be
4646 spent without legislative appropriation and only to administer,
4747 operate, preserve, repair, expand, or otherwise maintain the
4848 monument and museum.
4949 (e) Interest and income from the assets of the Iwo Jima
5050 monument and museum fund shall be credited to and deposited in the
5151 fund.
5252 SECTION 2. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2023.
