7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Chapter 442, Government Code, is amended by |
---|
9 | 9 | | adding Subchapter B-2 to read as follows: |
---|
10 | 10 | | SUBCHAPTER B-2. IWO JIMA MONUMENT AND MUSEUM |
---|
11 | 11 | | Sec. 442.065. DEFINITION. In this subchapter, "monument |
---|
12 | 12 | | and museum" means the Iwo Jima monument and museum at the Marine |
---|
13 | 13 | | Military Academy in Harlingen, Texas. |
---|
14 | 14 | | Sec. 442.066. IWO JIMA MONUMENT AND MUSEUM; FUND. (a) To |
---|
15 | 15 | | the extent authorized by law, the commission may enter into a |
---|
16 | 16 | | contract with the nonprofit entity that owns the monument and |
---|
17 | 17 | | museum to transfer to the commission the operation and management |
---|
18 | 18 | | of the monument and museum. |
---|
19 | 19 | | (b) The contract authorized by this section must include |
---|
20 | 20 | | provisions for: |
---|
21 | 21 | | (1) expanding, renovating, managing, maintaining, |
---|
22 | 22 | | operating, or providing financial support for the monument and |
---|
23 | 23 | | museum, including administration, construction and operation of a |
---|
24 | 24 | | visitor center, and related activities; |
---|
25 | 25 | | (2) preserving military documents, relics, and other |
---|
26 | 26 | | items of historical interest; |
---|
27 | 27 | | (3) employing a museum director and other employees |
---|
28 | 28 | | the commission considers necessary to fulfill its duties and |
---|
29 | 29 | | responsibilities under the contract; |
---|
30 | 30 | | (4) accepting donations of money, property, and |
---|
31 | 31 | | historical relics; and |
---|
32 | 32 | | (5) acquiring property and historical relics with |
---|
33 | 33 | | funds available for that purpose. |
---|
34 | 34 | | (c) The Iwo Jima monument and museum fund is created as a |
---|
35 | 35 | | fund outside the state treasury. The commission shall administer |
---|
36 | 36 | | the fund but may contract with the nonprofit entity that owns the |
---|
37 | 37 | | monument and museum for administration of the fund. The fund |
---|
38 | 38 | | consists of: |
---|
39 | 39 | | (1) admissions revenue from the operation of the |
---|
40 | 40 | | monument and museum; |
---|
41 | 41 | | (2) sales revenue from the operation of the monument |
---|
42 | 42 | | and museum gift shop; and |
---|
43 | 43 | | (3) donations made to the commission for the monument |
---|
44 | 44 | | and museum. |
---|
45 | 45 | | (d) Money in the Iwo Jima monument and museum fund may be |
---|
46 | 46 | | spent without legislative appropriation and only to administer, |
---|
47 | 47 | | operate, preserve, repair, expand, or otherwise maintain the |
---|
48 | 48 | | monument and museum. |
---|
49 | 49 | | (e) Interest and income from the assets of the Iwo Jima |
---|
50 | 50 | | monument and museum fund shall be credited to and deposited in the |
---|
51 | 51 | | fund. |
---|
52 | 52 | | SECTION 2. This Act takes effect immediately if it receives |
---|
53 | 53 | | a vote of two-thirds of all the members elected to each house, as |
---|
54 | 54 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
55 | 55 | | Act does not receive the vote necessary for immediate effect, this |
---|
56 | 56 | | Act takes effect September 1, 2023. |
