77 relating to senior justice assessment centers in certain counties.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Title 6, Human Resources Code, is amended by
1010 adding Chapter 106 to read as follows:
1111 CHAPTER 106. SENIOR JUSTICE ASSESSMENT CENTERS
1212 Sec. 106.001. ESTABLISHMENT OF SENIOR JUSTICE ASSESSMENT
1313 CENTERS. A county with a population of one million or more shall
1414 establish a senior justice assessment center.
1515 Sec. 106.002. DUTIES. (a) A senior justice assessment
1616 center shall provide services to seniors to ensure the dignity of
1717 seniors through increased public awareness, educational outreach,
1818 and promotion of justice regarding elder abuse.
1919 (b) A senior justice assessment center shall:
2020 (1) provide services to assist in the investigation of
2121 elder abuse through a multidisciplinary team composed of
2222 representatives of the following in the county:
2323 (A) the sheriff and each municipal law
2424 enforcement agency with jurisdiction to investigate elder abuse;
2525 (B) the adult protective services agency;
2626 (C) each attorney representing the state with
2727 jurisdiction to prosecute elder abuse cases;
2828 (D) the area agency on aging; and
2929 (E) public health care institutions, including
3030 postsecondary institutions providing health care services in the
3131 area; and
3232 (2) establish processes and procedures to:
3333 (A) determine whether elder abuse has been
3434 committed or whether other forms of neglect or exploitation of a
3535 senior have occurred;
3636 (B) evaluate the senior's mental capacity and
3737 ensure the senior's physical safety; and
3838 (C) make appropriate referrals to ensure the
3939 provision of comprehensive care and the promotion of justice for
4040 the senior based on the senior's individual needs.
4141 (c) In providing services to seniors, a senior justice
4242 assessment center shall collaborate with experts in:
4343 (1) geriatric medicine;
4444 (2) social services;
4545 (3) protective services;
4646 (4) law enforcement;
4747 (5) civil enforcement; and
4848 (6) criminal prosecution.
4949 SECTION 2. This Act takes effect September 1, 2023.
