55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a municipality or county to regulate
88 the locations in which a person may carry a firearm.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 229.001, Local Government Code, is
1111 amended by amending Subsection (b) and adding Subsection (d-2) to
1212 read as follows:
1313 (b) Subsection (a) does not affect the authority a
1414 municipality has under another law to:
1515 (1) require residents or public employees to be armed
1616 for personal or national defense, law enforcement, or another
1717 lawful purpose;
1818 (2) regulate the discharge of firearms or air guns
1919 within the limits of the municipality, other than at a sport
2020 shooting range;
2121 (3) except as provided by Subsection (b-1), adopt or
2222 enforce a generally applicable zoning ordinance, land use
2323 regulation, fire code, or business ordinance;
2424 (4) regulate the storage or transportation of
2525 explosives to protect public health and safety, except that 25
2626 pounds or less of black powder for each private residence and 50
2727 pounds or less of black powder for each retail dealer are not
2828 subject to regulation;
2929 (5) regulate the carrying of an air gun or firearm,
3030 other than a handgun carried by a person not otherwise prohibited by
3131 law from carrying a handgun, at a:
3232 (A) public park;
3333 (B) public meeting of a municipality, county, or
3434 other governmental body;
3535 (C) political rally, parade, or official
3636 political meeting; or
3737 (D) nonfirearms-related school, college, or
3838 professional athletic event;
3939 (6) regulate the carrying of a firearm by a person
4040 licensed to carry a handgun under Subchapter H, Chapter 411,
4141 Government Code, in accordance with Section 411.209, Government
4242 Code;
4343 (7) regulate the hours of operation of a sport
4444 shooting range, except that the hours of operation may not be more
4545 limited than the least limited hours of operation of any other
4646 business in the municipality other than a business permitted or
4747 licensed to sell or serve alcoholic beverages for on-premises
4848 consumption;
4949 (8) regulate the carrying of an air gun by a minor on:
5050 (A) public property; or
5151 (B) private property without consent of the
5252 property owner; [or]
5353 (9) except as provided by Subsection (d-1), regulate
5454 or prohibit an employee's carrying or possession of a firearm,
5555 firearm accessory, or ammunition in the course of the employee's
5656 official duties; or
5757 (10) except as provided by Subsection (d-2), regulate
5858 or prohibit the carrying of a firearm on the premises of a location
5959 where activities for children are regularly conducted, including a
6060 museum or a child-care or recreational facility.
6161 (d-2) Subsection (b)(10) does not authorize a municipality
6262 to regulate or prohibit the carrying of a firearm by a person
6363 described by Section 46.15(a)(1) or (b)(1), Penal Code, or by a
6464 person who is otherwise authorized to carry a firearm under a
6565 license or commission issued under Chapter 1702, Occupations Code.
6666 SECTION 2. Section 236.002, Local Government Code, is
6767 amended by amending Subsection (c) and adding Subsection (e-1) to
6868 read as follows:
6969 (c) Subsection (a) does not affect the authority of a county
7070 to:
7171 (1) require a resident or public employee to be armed
7272 for personal or national defense, law enforcement, or other purpose
7373 under other law;
7474 (2) regulate the discharge of firearms or air guns in
7575 accordance with Section 235.022;
7676 (3) regulate the carrying of a firearm by a person
7777 licensed to carry a handgun under Subchapter H, Chapter 411,
7878 Government Code, in accordance with Section 411.209, Government
7979 Code;
8080 (4) except as provided by Subsection (d), adopt or
8181 enforce a generally applicable land use regulation, fire code, or
8282 business regulation; [or]
8383 (5) except as provided by Subsection (e), regulate or
8484 prohibit an employee's carrying or possession of a firearm, firearm
8585 accessory, or ammunition in the course of the employee's official
8686 duties; or
8787 (6) except as provided by Subsection (e-1), regulate
8888 or prohibit the carrying of a firearm on the premises of a location
8989 where activities for children are regularly conducted, including a
9090 museum or a child-care or recreational facility.
9191 (e-1) Subsection (c)(6) does not authorize a county to
9292 regulate or prohibit the carrying of a firearm by a person described
9393 by Section 46.15(a)(1) or (b)(1), Penal Code, or by a person who is
9494 otherwise authorized to carry a firearm under a license or
9595 commission issued under Chapter 1702, Occupations Code.
9696 SECTION 3. This Act takes effect September 1, 2023.
