55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to prohibiting the carrying, possession, or storage of a
88 semiautomatic rifle on the campus of a public or private
99 institution of higher education; creating a criminal offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 46.03, Penal Code, is amended by adding
1212 Subsection (a-1) to read as follows:
1313 (a-1) A person commits an offense if the person carries,
1414 possesses, or stores a semiautomatic rifle in any location on the
1515 campus of an institution of higher education or private or
1616 independent institution of higher education, including:
1717 (1) a building or a portion of a building;
1818 (2) a driveway, street, sidewalk, or walkway, or a
1919 parking lot, parking garage, or other parking area; and
2020 (3) a dormitory or other residential facility owned or
2121 leased and operated by the institution and located on the campus of
2222 the institution.
2323 SECTION 2. Section 46.03(c), Penal Code, is amended by
2424 adding Subdivisions (1-a) and (6) to read as follows:
2525 (1-a) "Campus" has the meaning assigned by Section
2626 411.2031, Government Code.
2727 (6) "Semiautomatic rifle" has the meaning assigned by
2828 18 U.S.C. Section 921.
2929 SECTION 3. Section 411.2032, Government Code, is amended by
3030 adding Subsection (c) to read as follows:
3131 (c) This section does not authorize a person, regardless of
3232 whether the person holds a license to carry a handgun under this
3333 chapter, to store or transport a semiautomatic rifle in a motor
3434 vehicle on the campus of the institution in violation of Section
3535 46.03(a-1), Penal Code.
3636 SECTION 4. The change in law made by this Act applies only
3737 to an offense committed on or after the effective date of this Act.
3838 An offense committed before the effective date of this Act is
3939 governed by the law in effect on the date the offense was committed,
4040 and the former law is continued in effect for that purpose. For
4141 purposes of this section, an offense was committed before the
4242 effective date of this Act if any element of the offense occurred
4343 before that date.
4444 SECTION 5. This Act takes effect September 1, 2023.
