| 7 | 7 | | relating to prohibiting the carrying, possession, or storage of a |
|---|
| 8 | 8 | | semiautomatic rifle on the campus of a public or private |
|---|
| 9 | 9 | | institution of higher education; creating a criminal offense. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 46.03, Penal Code, is amended by adding |
|---|
| 12 | 12 | | Subsection (a-1) to read as follows: |
|---|
| 13 | 13 | | (a-1) A person commits an offense if the person carries, |
|---|
| 14 | 14 | | possesses, or stores a semiautomatic rifle in any location on the |
|---|
| 15 | 15 | | campus of an institution of higher education or private or |
|---|
| 16 | 16 | | independent institution of higher education, including: |
|---|
| 17 | 17 | | (1) a building or a portion of a building; |
|---|
| 18 | 18 | | (2) a driveway, street, sidewalk, or walkway, or a |
|---|
| 19 | 19 | | parking lot, parking garage, or other parking area; and |
|---|
| 20 | 20 | | (3) a dormitory or other residential facility owned or |
|---|
| 21 | 21 | | leased and operated by the institution and located on the campus of |
|---|
| 22 | 22 | | the institution. |

| 23 | 23 | | SECTION 2. Section 46.03(c), Penal Code, is amended by |
|---|
| 24 | 24 | | adding Subdivisions (1-a) and (6) to read as follows: |
|---|
| 25 | 25 | | (1-a) "Campus" has the meaning assigned by Section |
|---|
| 26 | 26 | | 411.2031, Government Code. |
|---|
| 27 | 27 | | (6) "Semiautomatic rifle" has the meaning assigned by |
|---|
| 28 | 28 | | 18 U.S.C. Section 921. |
|---|
| 29 | 29 | | SECTION 3. Section 411.2032, Government Code, is amended by |
|---|
| 30 | 30 | | adding Subsection (c) to read as follows: |
|---|
| 31 | 31 | | (c) This section does not authorize a person, regardless of |
|---|
| 32 | 32 | | whether the person holds a license to carry a handgun under this |
|---|
| 33 | 33 | | chapter, to store or transport a semiautomatic rifle in a motor |
|---|
| 34 | 34 | | vehicle on the campus of the institution in violation of Section |
|---|
| 35 | 35 | | 46.03(a-1), Penal Code. |
|---|
| 36 | 36 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 37 | 37 | | to an offense committed on or after the effective date of this Act. |
|---|
| 38 | 38 | | An offense committed before the effective date of this Act is |
|---|
| 39 | 39 | | governed by the law in effect on the date the offense was committed, |
|---|
| 40 | 40 | | and the former law is continued in effect for that purpose. For |
|---|
| 41 | 41 | | purposes of this section, an offense was committed before the |
|---|
| 42 | 42 | | effective date of this Act if any element of the offense occurred |
|---|
| 43 | 43 | | before that date. |
|---|
| 44 | 44 | | SECTION 5. This Act takes effect September 1, 2023. |
