| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Chapter 490I, Government Code, is amended by |
|---|
| 9 | 9 | | adding Section 490I.01051 to read as follows: |
|---|
| 10 | 10 | | Sec. 490I.01051. MAP OF LOCATIONS RECEIVING BROADBAND AND |
|---|
| 11 | 11 | | CERTAIN TELECOMMUNICATIONS SERVICES; REPORT. (a) The Public |
|---|
| 12 | 12 | | Utility Commission of Texas shall create, update annually, and |
|---|
| 13 | 13 | | publish on the commission's Internet website a map that shows |
|---|
| 14 | 14 | | locations in this state that are: |
|---|
| 15 | 15 | | (1) receiving reliable broadband service at speeds of |
|---|
| 16 | 16 | | not less than 100 megabits per second for a download and not less |
|---|
| 17 | 17 | | than 20 megabits per second for an upload; |
|---|
| 18 | 18 | | (2) served by an eligible telecommunications provider |
|---|
| 19 | 19 | | under Section 56.023, Utilities Code, that receives support for |
|---|
| 20 | 20 | | that purpose under a plan of the state universal service fund |
|---|
| 21 | 21 | | established under Section 56.021, Utilities Code; and |
|---|
| 22 | 22 | | (3) described by both Subdivisions (1) and (2). |
|---|
| 23 | 23 | | (b) The comptroller shall assist the Public Utility |
|---|
| 24 | 24 | | Commission of Texas in creating and updating the map described by |
|---|
| 25 | 25 | | Subsection (a). |
|---|
| 26 | 26 | | (c) Not later than December 1 of each year, the Public |
|---|
| 27 | 27 | | Utility Commission of Texas shall submit a report to the governor, |
|---|
| 28 | 28 | | the lieutenant governor, the speaker of the house of |
|---|
| 29 | 29 | | representatives, and the legislature that shows the locations |
|---|
| 30 | 30 | | described by Subsection (a)(3). |
|---|
| 31 | 31 | | SECTION 2. The Public Utility Commission of Texas must |
|---|
| 32 | 32 | | submit the first report required under Section 490I.01051, |
|---|
| 33 | 33 | | Government Code, as added by this Act, not later than December 1, |
|---|
| 34 | 34 | | 2024. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2023. |
