55 relating to the identification of locations receiving broadband and

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 490I, Government Code, is amended by
99 adding Section 490I.01051 to read as follows:
1010 Sec. 490I.01051. MAP OF LOCATIONS RECEIVING BROADBAND AND
1111 CERTAIN TELECOMMUNICATIONS SERVICES; REPORT. (a) The Public
1212 Utility Commission of Texas shall create, update annually, and
1313 publish on the commission's Internet website a map that shows
1414 locations in this state that are:
1515 (1) receiving reliable broadband service at speeds of
1616 not less than 100 megabits per second for a download and not less
1717 than 20 megabits per second for an upload;
1818 (2) served by an eligible telecommunications provider
1919 under Section 56.023, Utilities Code, that receives support for
2020 that purpose under a plan of the state universal service fund
2121 established under Section 56.021, Utilities Code; and
2222 (3) described by both Subdivisions (1) and (2).
2323 (b) The comptroller shall assist the Public Utility
2424 Commission of Texas in creating and updating the map described by
2525 Subsection (a).
2626 (c) Not later than December 1 of each year, the Public
2727 Utility Commission of Texas shall submit a report to the governor,
2828 the lieutenant governor, the speaker of the house of
2929 representatives, and the legislature that shows the locations
3030 described by Subsection (a)(3).
3131 SECTION 2. The Public Utility Commission of Texas must
3232 submit the first report required under Section 490I.01051,
3333 Government Code, as added by this Act, not later than December 1,
3434 2024.
3535 SECTION 3. This Act takes effect September 1, 2023.
