7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Subchapter B, Chapter 28, Education Code, is |
---|
9 | 9 | | amended by adding Section 28.029 to read as follows: |
---|
10 | 10 | | Sec. 28.029. MIDDLE SCHOOL ADVANCED MATHEMATICS PROGRAM. |
---|
11 | 11 | | (a) To increase the number of students who complete advanced |
---|
12 | 12 | | mathematics courses in high school, each school district and |
---|
13 | 13 | | open-enrollment charter school shall develop an advanced |
---|
14 | 14 | | mathematics program for middle school students that is designed to |
---|
15 | 15 | | enable those students to enroll in Algebra I in eighth grade. |
---|
16 | 16 | | (b) Under the program, subject to Subsection (c), a school |
---|
17 | 17 | | district or open-enrollment charter school shall automatically |
---|
18 | 18 | | enroll in an advanced mathematics course each sixth grade student |
---|
19 | 19 | | who performed in the top 40 percent on: |
---|
20 | 20 | | (1) the fifth grade mathematics assessment instrument |
---|
21 | 21 | | administered under Section 39.023(a); or |
---|
22 | 22 | | (2) a local measure that includes the student's fifth |
---|
23 | 23 | | grade class ranking or a demonstrated proficiency in the student's |
---|
24 | 24 | | fifth grade mathematics coursework. |
---|
25 | 25 | | (c) The parent or guardian of a student described by |
---|
26 | 26 | | Subsection (b) may opt the student out of automatic enrollment |
---|
27 | 27 | | under that subsection. |
---|
28 | 28 | | (d) The commissioner may adopt rules to implement this |
---|
29 | 29 | | section. |
---|
30 | 30 | | SECTION 2. As soon as practicable after the effective date |
---|
31 | 31 | | of this Act, each school district or open-enrollment charter school |
---|
32 | 32 | | shall develop the middle school advanced mathematics program |
---|
33 | 33 | | required by Section 28.029, Education Code, as added by this Act. |
---|
34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
---|
35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
---|
36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
---|
38 | 38 | | Act takes effect September 1, 2023. |
