55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of the Task Force on Concrete Plants.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. TASK FORCE ON CONCRETE PLANTS. (a) The Task
1010 Force on Concrete Plants is established.
1111 (b) The task force shall consult with experts on and study
1212 the effects of air and noise pollution caused by concrete batch and
1313 crushing plants in this state. After completing the study, the task
1414 force shall:
1515 (1) develop recommendations for legislation to:
1616 (A) reduce air and noise pollution caused by
1717 concrete batch and crushing plants;
1818 (B) improve the processes for issuing permits for
1919 and inspecting concrete batch and crushing plants; and
2020 (C) improve enforcement of statutes and rules
2121 that apply to concrete batch and crushing plants; and
2222 (2) identify best practices to reduce air and noise
2323 pollution caused by concrete batch and crushing plants.
2424 (c) The task force is composed of the following members:
2525 (1) two members of the house of representatives
2626 appointed by the speaker of the house of representatives;
2727 (2) two members of the senate appointed by the
2828 lieutenant governor;
2929 (3) the executive director of the Texas Commission on
3030 Environmental Quality or the director's designee; and
3131 (4) seven members appointed by the governor as
3232 follows:
3333 (A) one member to represent concrete batch and
3434 crushing plant operators;
3535 (B) one member to represent an institution of
3636 higher education in the state who must have published research
3737 regarding environmental pollutants;
3838 (C) one member who is a toxicologist certified by
3939 the American Board of Toxicology or an equivalent entity;
4040 (D) one member who is a professional with
4141 experience in geographic information systems; and
4242 (E) three members to represent community
4343 organizations who each reside not more than five miles from a
4444 concrete batch or crushing plant.
4545 (d) The governor shall designate one member of the task
4646 force to serve as the presiding officer.
4747 (e) A member of the task force is not entitled to
4848 compensation but is entitled to reimbursement for the member's
4949 travel expenses as provided by Chapter 660, Government Code, and
5050 the General Appropriations Act.
5151 (f) Not later than December 1, 2024, the task force shall:
5252 (1) compile a report of its findings and
5353 recommendations; and
5454 (2) submit the report to the governor, the lieutenant
5555 governor, and the speaker of the house of representatives.
5656 (g) Chapter 2110, Government Code, does not apply to this
5757 task force.
5858 (h) The task force is abolished and this Act expires on
5959 January 1, 2025.
6060 SECTION 2. APPOINTMENT OF MEMBERS. As soon as practicable
6161 after the effective date of this Act, the governor, the lieutenant
6262 governor, and the speaker of the house of representatives shall
6363 appoint members to the Task Force on Concrete Plants as required by
6464 this Act.
6565 SECTION 3. EFFECTIVE DATE. This Act takes effect
6666 immediately if it receives a vote of two-thirds of all the members
6767 elected to each house, as provided by Section 39, Article III, Texas
6868 Constitution. If this Act does not receive the vote necessary for
6969 immediate effect, this Act takes effect September 1, 2023.
