9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 244.001, Human Resources Code, is |
---|
11 | 11 | | amended by adding Subsection (e) to read as follows: |

12 | 12 | | (e) The department may not use telemedicine or mental health |
---|
13 | 13 | | telemedicine or telehealth services for any purpose under this |
---|
14 | 14 | | section. |
---|
15 | 15 | | SECTION 2. Subchapter A, Chapter 244, Human Resources Code, |
---|
16 | 16 | | is amended by adding Section 244.0095 to read as follows: |

17 | 17 | | Sec. 244.0095. CERTAIN MEDICAL CARE SERVICES REQUIRED. In |
---|
18 | 18 | | providing medical care, the department shall contract for |
---|
19 | 19 | | telemedicine services to be available when a physician, advanced |
---|
20 | 20 | | practice registered nurse, or physician assistant is not present at |
---|
21 | 21 | | the facility where the services are to be provided. |
---|
22 | 22 | | SECTION 3. This Act takes effect September 1, 2023. |
