55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the course information required to be posted on a public
88 institution of higher education's Internet website; providing an
99 administrative penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 51.974, Education Code, is amended by
1212 amending Subsections (a), (b), (f), and (g) and adding Subsections
1313 (f-1) and (f-2) to read as follows:
1414 (a) Each institution of higher education, other than a
1515 medical and dental unit, as defined by Section 61.003, shall make
1616 available to the public on the institution's Internet website the
1717 following information for each [undergraduate] classroom course
1818 offered for credit by the institution:
1919 (1) a syllabus that:
2020 (A) satisfies any standards adopted by the
2121 institution;
2222 (B) provides a brief description of each major
2323 course requirement, including each major assignment and
2424 examination;
2525 (C) lists any required or recommended reading;
2626 and
2727 (D) provides a general description of the subject
2828 matter of each lecture or discussion;
2929 (2) a curriculum vitae of each regular instructor that
3030 lists the instructor's:
3131 (A) postsecondary education;
3232 (B) teaching experience; and
3333 (C) significant professional publications; and
3434 (3) if available, a departmental budget report of the
3535 department under which the course is offered, from the most recent
3636 semester or other academic term during which the institution
3737 offered the course.
3838 (b) The information required by Subsection (a) must be:
3939 (1) accessible from the institution's Internet website
4040 home page [by use of not more than three links];
4141 (2) clearly labeled as "public course and syllabus
4242 information";
4343 (3) searchable by keywords and phrases; and
4444 (4) [(3)] accessible to the public without requiring
4545 registration or use of a user name, a password, or another user
4646 identification.
4747 (f) Not later than January 1 of each odd-numbered year, each
4848 institution of higher education shall submit a written report
4949 regarding the institution's compliance with this section to the
5050 governor, the lieutenant governor, the speaker of the house of
5151 representatives, [and] the presiding officer of each legislative
5252 standing committee with primary jurisdiction over higher
5353 education, and the Texas Higher Education Coordinating Board.
5454 (f-1) The Texas Higher Education Coordinating Board shall
5555 monitor each institution of higher education to determine whether
5656 the institution is in substantial compliance with this section and
5757 make available to the public on the coordinating board's Internet
5858 website:
5959 (1) a list indicating whether each institution of
6060 higher education is in substantial compliance with this section;
6161 and
6262 (2) a copy of each report submitted to the
6363 coordinating board under Subsection (f).
6464 (f-2) The Texas Higher Education Coordinating Board shall
6565 assess an administrative penalty of $5,000 against an institution
6666 of higher education that violates Subsections (a) or (b). Each day
6767 the violation continues or occurs is a separate violation for
6868 purposes of assessing a penalty.
6969 (g) The Texas Higher Education Coordinating Board may adopt
7070 rules necessary to administer this section, including rules to:
7171 (1) ensure substantial compliance with this section;
7272 and
7373 (2) assess administrative penalties under Subsection
7474 (f-2).
7575 SECTION 2. Section 51.974, Education Code, as amended by
7676 this Act, applies beginning with the 2024 spring semester.
7777 SECTION 3. This Act takes effect September 1, 2023.
