66 relating to the creation of the West Plains Municipal Management
77 District No. 1; providing authority to issue bonds; providing
88 authority to impose assessments, fees, and taxes.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1111 Code, is amended by adding Chapter ____ to read as follows:
1212 CHAPTER . WEST PLAINS MUNICIPAL MANAGEMENT DISTRICT NO. 1
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. .0001. DEFINITIONS. In this chapter:
1515 (1) "Board" means the district's board of directors.
1616 (2) "City" means the City of Amarillo.
1717 (3) "Director" means a board member.
1818 (4) "District" means the West Plains Municipal
1919 Management District No. 1.
2020 (5) "Rail facilities" includes all real and personal
2121 property owned or held by the district for railroad purposes,
2222 including land, interests in land, structures, easements, rail
2323 lines, stations, platforms, rolling stock, garages, equipment, and
2424 other facilities necessary or convenient for the operation of those
2525 facilities.
2626 Sec. .0002. NATURE OF DISTRICT. The West Plains Municipal
2727 Management District No. 1 is a special district created under
2828 Section 59, Article XVI, Texas Constitution.
2929 Sec. .0003. PURPOSE; DECLARATION OF INTENT. (a) The
3030 creation of the district is essential to accomplish the purposes of
3131 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
3232 Texas Constitution, and other public purposes stated in this
3333 chapter.
3434 (b) By creating the district and in the city and other
3535 political subdivisions to contract with the district, the
3636 legislature has established a program to accomplish the public
3737 purposes set out in Section 52-a, Article III, Texas Constitution.
3838 (c) The creation of the district is necessary to promote,
3939 develop, encourage, and maintain employment, commerce,
4040 transportation, housing, tourism, recreation, the arts,
4141 entertainment, economic development, safety, and the public
4242 welfare in the district.
4343 (d) This chapter and the creation of the district may not be
4444 interpreted to relieve the city from providing the level of
4545 services provided as of the effective date of the Act enacting this
4646 chapter to the area in the district. The district is created to
4747 supplement and not to supplant city services provided in the
4848 district.
4949 Sec. .0004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a)
5050 All land and other property included in the district will benefit
5151 from the improvements and services to be provided by the district
5252 under powers conferred by Sections 52 and 52-a, Article III, and
5353 Section 59, Article XVI, Texas Constitution, and other powers
5454 granted under this chapter.
5555 (b) The district is created to serve a public use and
5656 benefit.
5757 (c) The creation of the district is in the public interest
5858 and is essential to further the public purposes of:
5959 (1) developing and diversifying the economy of the
6060 state;
6161 (2) eliminating unemployment and underemployment; and
6262 (3) developing or expanding transportation and
6363 commerce.
6464 (d) The district will:
6565 (1) promote the health, safety, and general welfare of
6666 residents, employers, potential employees, employees, visitors,
6767 and consumers in the district, and of the public;
6868 (2) provide needed funding for the district to
6969 preserve, maintain, and enhance the economic health and vitality of
7070 the district territory as a community and business center;
7171 (3) promote the health, safety, welfare, and enjoyment
7272 of the public by providing pedestrian ways and by landscaping and
7373 developing certain areas in the district, which are necessary for
7474 the restoration, preservation, and enhancement of scenic beauty;
7575 and
7676 (4) provide for water, wastewater, drainage, road,
7777 rail and recreational facilities for the district.
7878 (e) Pedestrian ways along or across a street, whether at
7979 grade or above or below the surface, and street lighting, street
8080 landscaping, parking, and street art objects are parts of and
8181 necessary components of a street and are considered to be a street
8282 or road improvement.
8383 (f) The district will not act as the agent or
8484 instrumentality of any private interest even though the district
8585 will benefit many private interests as well as the public.
8686 Sec. .0005. INITIAL DISTRICT TERRITORY. (a) The
8787 district is initially composed of the territory described by
8888 Section 2 of the Act enacting this chapter.
8989 (b) The boundaries and field notes contained in Section 2 of
9090 the Act enacting this chapter form a closure. A mistake in the field
9191 notes or in copying the field notes in the legislative process does
9292 not affect the district's:
9393 (1) organization, existence, or validity;
9494 (2) right to issue any type of bonds for the purposes
9595 for which the district is created or to pay the principal of and
9696 interest on the bonds;
9797 (3) right to impose or collect an assessment or tax; or
9898 (4) legality or operation.
9999 Sec. .0006. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
100100 All or any part of the area of the district is eligible to be
101101 included in:
102102 (1) a tax increment reinvestment zone created under
103103 Chapter 311, Tax Code; or
104104 (2) a tax abatement reinvestment zone created under
105105 Chapter 312, Tax Code.
106106 Sec. .0007. APPLICABILITY OF MUNICIPAL MANAGEMENT
107107 DISTRICTS LAW. Except as otherwise provided by this chapter,
108108 Chapter 375, Local Government Code, applies to the district.
109109 Sec. .0008. CONSTRUCTION OF CHAPTER. This chapter shall
110110 be liberally construed in conformity with the findings and purposes
111111 stated in this chapter.
112112 SUBCHAPTER B. BOARD OF DIRECTORS
113113 Sec. .0051. GOVERNING BODY; TERMS.(a) The district is
114114 governed by a board of five elected directors who serve staggered
115115 terms of four years.
116116 (b) Directors are elected in the manner provided by
117117 Subchapter D, Chapter 49, Water Code.
118118 Sec. .052. COMPENSATION; EXPENSES. (a) The district may
119119 compensate each director in an amount not to exceed $150 for each
120120 board meeting. The total amount of compensation for each director
121121 in one year may not exceed $7,200.
122122 (b) A director is entitled to reimbursement for necessary
123123 and reasonable expenses incurred in carrying out the duties and
124124 responsibilities of the board.
125125 Sec. .0053. INITIAL DIRECTORS. (a) The initial board
126126 consists of the following directors:

133133 (b) Of the initial directors, the terms of directors

137137 SUBCHAPTER C. POWERS AND DUTIES
138138 Sec. .0101. GENERAL POWERS AND DUTIES. The district has the
139139 powers and duties necessary to accomplish the purposes for which
140140 the district is created.
141141 Sec. .0102. IMPROVEMENT PROJECTS AND SERVICES. (a) The
142142 district, using any money available to the district for the
143143 purpose, may provide, design, construct, acquire, improve,
144144 relocate, operate, maintain, or finance an improvement project or
145145 service authorized under this chapter or Chapter 375, Local
146146 Government Code.
147147 (b) The district may contract with a governmental or private
148148 entity to carry out an action under Subsection (a).
149149 (c) The implementation of a district project or service is a
150150 governmental function or service for the purposes of Chapter 791,
151151 Government Code.
152152 Sec. .0103. NONPROFIT CORPORATION. (a) The board by
153153 resolution may authorize the creation of a nonprofit corporation to
154154 assist and act for the district in implementing a project or
155155 providing a service authorized by this chapter.
156156 (b) The nonprofit corporation:
157157 (1) has each power of and is considered to be a local
158158 government corporation created under Subchapter D, Chapter 431,
159159 Transportation Code; and
160160 (2) may implement any project and provide any service
161161 authorized by this chapter.
162162 (c) The board shall appoint the board of directors of the
163163 nonprofit corporation. The board of directors of the nonprofit
164164 corporation shall serve in the same manner as the board of directors
165165 of a local government corporation created under Subchapter D,
166166 Chapter 431, Transportation Code, except that a board member is not
167167 required to reside in the district.
168168 Sec. .0104. LAW ENFORCEMENT SERVICES. To protect the
169169 public interest, the district may contract with a qualified party,
170170 including the city, to provide law enforcement services in the
171171 district for a fee.
172172 Sec. .0105. MEMBERSHIP IN CHARITABLE ORGANIZATIONS. The
173173 district may join and pay dues to a charitable or nonprofit
174174 organization that performs a service or provides an activity
175175 consistent with the furtherance of a district purpose.
176176 Sec. .0106. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
177177 district may engage in activities that accomplish the economic
178178 development purposes of the district.
179179 (b) The district may establish and provide for the
180180 administration of one or more programs to promote state or local
181181 economic development and to stimulate business and commercial
182182 activity in the district, including programs to:
183183 (1) make loans and grants of public money; and
184184 (2) provide district personnel and services.
185185 (c) The district may create economic development programs
186186 and exercise the economic development powers provided to
187187 municipalities by:
188188 (1) Chapter 380, Local Government Code; and
189189 (2) Subchapter A, Chapter 1509, Government Code.
190190 Sec. .0107. PARKING FACILITIES. (a) The district may
191191 acquire, lease as lessor or lessee, construct, develop, own,
192192 operate, and maintain parking facilities or a system of parking
193193 facilities, including lots, garages, parking terminals, or other
194194 structures or accommodations for parking motor vehicles off the
195195 streets and related appurtenances.
196196 (b) The district's parking facilities serve the public
197197 purposes of the district and are owned, used, and held for a public
198198 purpose even if leased or operated by a private entity for a term of
199199 years.
200200 (c) The district's parking facilities are parts of and
201201 necessary components of a street and are considered to be a street
202202 or road improvement.
203203 (d) The development and operation of the district's parking
204204 facilities may be considered an economic development program.
205205 Sec. .0108. ADDING OR EXCLUDING LAND. The district may add
206206 or exclude land in the manner provided by Subchapter J, Chapter 49,
207207 Water Code, or by Subchapter H, Chapter 54, Water Code.
208208 Sec. .0109. DISBURSEMENTS AND TRANSFERS OF MONEY. The
209209 board by resolution shall establish the number of directors'
210210 signatures and the procedure required for a disbursement or
211211 transfer of district money.
212212 Sec. .0110. RAIL FACILITIES. The district may construct,
213213 acquire, improve, maintain, finance, and operate rail facilities
214214 and improvements for freight or other rail purposes.
215215 Sec. .0111. NO EMINENT DOMAIN POWER. The district may not
216216 exercise the power of eminent domain.
217217 SUBCHAPTER D. ASSESSMENTS
218218 Sec. .0151. PETITION REQUIRED FOR FINANCING SERVICES AND
219219 IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
220220 service or improvement project with assessments under this chapter
221221 unless a written petition requesting that service or improvement
222222 has been filed with the board.
223223 (b) A petition filed under Subsection (a) must be signed by
224224 the owners of a majority of the assessed value of real property in
225225 the district subject to assessment according to the most recent
226226 certified tax appraisal roll for the county.
227227 Sec. .0152. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a) The
228228 board by resolution may impose and collect an assessment for any
229229 purpose authorized by this chapter in all or any part of the
230230 district.
231231 (b) An assessment, a reassessment, or an assessment
232232 resulting from an addition to or correction of the assessment roll
233233 by the district, penalties and interest on an assessment or
234234 reassessment, an expense of collection, and reasonable attorney's
235235 fees incurred by the district:
236236 (1) are a first and prior lien against the property
237237 assessed;
238238 (2) are superior to any other lien or claim other than a
239239 lien or claim for county, school district, or municipal ad valorem
240240 taxes; and
241241 (3) are the personal liability of and a charge against
242242 the owners of the property even if the owners are not named in the
243243 assessment proceedings.
244244 (c) The lien is effective from the date of the board's
245245 resolution imposing the assessment until the date the assessment is
246246 paid. The board may enforce the lien in the same manner that the
247247 board may enforce an ad valorem tax lien against real property.
248248 (d) The board may make a correction to or deletion from the
249249 assessment roll that does not increase the amount of assessment of
250250 any parcel of land without providing notice and holding a hearing in
251251 the manner required for additional assessments.
252252 SUBCHAPTER E. TAXES AND BONDS
253253 Sec. .0201. TAX ELECTION REQUIRED. The district must hold
254254 an election in the manner provided by Chapter 49, Water Code, or, if
255255 applicable, Chapter 375, Local Government Code, to obtain voter
256256 approval before the district may impose an ad valorem tax.
257257 (b) Section 375.243, Local Government Code, does not apply
258258 to this section.
259259 Sec. .0202. OPERATION AND MAINTENANCE TAX. (a) If
260260 authorized by a majority of the district voters voting at an
261261 election under Section .0201, the district may impose an operation
262262 and maintenance tax on taxable property in the district in the
263263 manner provided by Section 49.107, Water Code, for any district
264264 purpose, including to:
265265 (1) maintain and operate the district;
266266 (2) construct or acquire improvements; or
267267 (3) provide a service.
268268 (b) The board shall determine the operation and maintenance
269269 tax rate. The rate may not exceed the rate approved at the
270270 election.
271271 Sec. .0203. AUTHORITY TO BORROW MONEY AND TO ISSUE BONDS
272272 AND OTHER OBLIGATIONS. (a) The district may borrow money on terms
273273 determined by the board.
274274 (b) The district may issue bonds, notes, or other
275275 obligations payable wholly or partly from ad valorem taxes,
276276 assessments, impact fees, revenue, contract payments, grants, or
277277 other district money, or any combination of those sources of money,
278278 to pay for any authorized district purpose.
279279 (c) The limitation on the outstanding principal amount of
280280 bonds, notes, or other obligations provided by Section 49.4645,
281281 Water Code, does not apply to the district.
282282 Sec. .0204. BONDS SECURED BY REVENUE OR CONTRACT PAYMENTS.
283283 The district may issue, without an election, bonds secured by:
284284 (1) revenue other than ad valorem taxes; or
285285 (2) contract payments, provided that the requirements
286286 of Section 49.108, Water Code, have been met;
287287 (3) other contract revenues
288288 Sec. .0205. BONDS SECURED BY AD VALOREM TAXES; ELECTIONS.
289289 (a) If authorized at an election under Section .0201, the
290290 district may issue bonds payable from ad valorem taxes.
291291 (b) At the time the district issues bonds payable wholly or
292292 partly from ad valorem taxes, the board shall provide for the annual
293293 imposition of a continuing direct annual ad valorem tax, without
294294 limit as to rate or amount, for each year that all or part of the
295295 bonds are outstanding as required and in the manner provided by
296296 Sections 54.601 and 54.602, Water Code.
297297 (c) All or any part of any facilities or improvements that
298298 may be acquired by a district by the issuance of its bonds may be
299299 submitted as a single proposition or as several propositions to be
300300 voted on at the election.
301301 Sec. .0206. CONSENT OF MUNICIPALITY REQUIRED. (a) The
302302 board may not issue bonds until each municipality in whose
303303 corporate limits or extraterritorial jurisdiction the district is
304304 located has consented by ordinance or resolution to the creation of
305305 the district and to the inclusion of land in the district.
306306 (b) This section applies only to the district's first
307307 issuance of bonds payable from ad valorem taxes.
308308 SUBCHAPTER Z. DISSOLUTION
309309 Sec. .0901. DISSOLUTION. (a) Except as limited by Section
310310 375.264, Local Government Code, the board shall dissolve the
311311 district on written petition filed with the board by the owners of:
312312 (1) 66 percent or more of the assessed value subject to
313313 assessment by the district of the property in the district based on
314314 the most recent certified county property tax rolls; or
315315 (2) 66 percent or more of the surface area of the
316316 district, excluding roads, streets, highways, utility
317317 rights-of-way, other public areas, and other property exempt from
318318 assessment by the district according to the most recent certified
319319 county property tax rolls.
320320 (b) The district may not be dissolved if the district:
321321 (1) has any outstanding bonded or other indebtedness
322322 until that bonded or other indebtedness has been repair or defeased
323323 in accordance with the order or resolution authorizing the issuance
324324 of the bonded or other indebtedness;
325325 (2) has a contractual obligation to pay money until
326326 that obligation has been fully paid in accordance with the
327327 contract; or
328328 (3) owns, operates, or maintains public works,
329329 facilities, or improvements unless the district has contracted with
330330 another party for the ownership and operation or maintenance of the
331331 public works, facilities, or improvements.
332332 (c) Section 375.262, Local Government Code, does not apply
333333 to the district.
334334 SECTION 2. The West Plains Municipal Management District
335335 No. 1 initially includes all territory contained in the following
336336 areas:
337337 (a) A 621.87 acre tract of land out of Sections 30 and 31,
338338 Block 2, A. B. & M. Survey, Potter County, Texas, and more
339339 particularly described as follows:
340340 BEGINNING at a Gresham Aluminum Cap found on the east
341341 right-of-way line of Spur 228 same being the southwest corner of
342342 said Section 30 for a corner of this tract.
343343 THENCE N. 00° 11' 35" E., along said east right-of-way line, a
344344 distance of 4161.54 feet to a/2" iron rod with a yellow cap
345345 inscribed "RPLS 4263" (such type cap and rod hereafter referred to
346346 as an OJD Cap) set on said east right-of-way line for the most
347347 westerly northwest corner of this tract.
348348 THENCE N. 87° 28' 24" E., continuing along said right-of-way
349349 line, a distance of 1.08 feet to a Gresham Aluminum Cap found for an
350350 angle corner of this tract.
351351 THENCE N. 40° 07' 53" E., along said right-of-way line, a
352352 distance of 116.08 feet to TxDot Brass Cap Monument found on the
353353 south right-of-way line of Interstate Highway No. 40 for the most
354354 northerly northwest corner of this tract.
355355 THENCE N. 80° 18' 54" E., along said south right-of-way line,
356356 a distance of 286.20 feet to a Gresham Aluminum Cap found on said
357357 south right-of-way line for an angle corner of this tract.
358358 THENCE N. 80° 18' 37" E., continuing along said south
359359 right-of-way line, a distance of 300.34 feet to a Gresham Aluminum
360360 Cap found on said south right-of-way line for an angle corner of
361361 this tract.
362362 THENCE N. 69° 11' 51" E., continuing along said south
363363 right-of-way line, a distance of 102.08 feet to a Gresham Aluminum
364364 Cap found on said south right-of-way line for an angle corner of
365365 this tract.
366366 THENCE N. 80° 26' 43" E., continuing along said south
367367 right-of-way line, a distance of 3052.07 feet to a Gresham Aluminum
368368 Cap found on said south right-of-way line same being the beginning
369369 of a curve to the right for a corner of this tract.

412412 THENCE N. 80° 33' 44" W., along said northerly right-of-way
413413 line, a distance of 5315.27 feet to a Gresham Aluminum Cap found on
414414 said east right-of-way line of said Spur 228 for the southwest
415415 corner of this tract.
416416 THENCE N. 00° 11' 35" E., along said east right-of-way line, a
417417 distance of 536.60 feet to the place of BEGINNING and containing
418418 621.87 acres of land.
419419 (b) An 11.30 acre± tract of land in Section 37, Block 2, A.B. &
420420 M. Survey, Potter County, Texas and being all of a 6.3 acre and a
421421 5.00 acre tract of land as described in that certain instrument of
422422 conveyance recorded under Clerk's File No. 20200PR0012200 of the
423423 Official Public Records of Potter County, Texas. Said 11.30 acre±
424424 tract of land having been surveyed on the ground by Furman Land
425425 Surveyors, Inc. on March 28, 2022 and being more particularly
426426 described by metes and bounds as follows:
427427 COMMENCING at a 2 inch iron pipe found as called for at the
428428 Northeast corner of said Section 37, Block 2, A.B. & M. Survey,
429429 Potter County, Texas;
430430 THENCE South 00° 04' 30" West (base line) along the East line
431431 of said Section 37, a distance of 2782.61 feet to a point, from
432432 whence a 2 inch iron pipe found as called for at the Southeast
433433 corner of said Section 37 bears South 00° 04' 30" West, 2495.32 feet;
434434 THENCE North 89° 55' 30" West, 119.69 feet to a 1/2 inch iron
435435 rod found as called for in the West monumented right-of-way line of
436436 Spur 228 (Volume 826, Page 117), same point being the most Easterly
437437 Northeast corner of a 365.69 acre tract of land as described in that
438438 certain instrument of conveyance recorded in Volume 3753, Page 786
439439 of the Official Public Records of Potter County, Texas and also
440440 being the Southeast corner of the herein described tract of land,
441441 from whence a 5/8 inch iron rod with cap stamped "RPLS 5437" found
442442 as called for at the Southeast corner of said 365.69 acre tract of
443443 land bears South 00° 04' 35" West, 3018.41 feet;
444444 THENCE South 85° 34' 44" West, 652.59 feet to a 1/2 inch iron
445445 rod found as called for, same point being an interior jog corner of
446446 said 365.69 acre tract of land and alsot being the Southwest corner
447447 of this tract of land;
448448 THENCE North 00° 03' 09" East, 726.94 feet to a 1/2 inch iron
449449 rod found as called for at the Southwest corner of a 4.92 acre tract
450450 of land as described in that certain instrument of conveyance
451451 recorded under Clerk's File No. 1302993 of the Official Public
452452 Records of Potter County, Texas, same point being the Northwest
453453 corner of this tract of land;
454454 THENCE North 80° 28' 11" East, 660.12 feet to a 1/2 inch iron
455455 rod found in the West monumented right-of-way line of said Spur 228
456456 at the Southeast corner of said 4.92 acre tract of land, same point
457457 being the Northeast corner of this tract of land;
458458 THENCE South 00° 04' 30" West, 785.93 feet to the PLACE OF

518518 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
519519 Government Code.
520520 (b) The governor, one of the required recipients, has
521521 submitted the notice and Act to the Texas Commission on
522522 Environmental Quality.
523523 (c) The Texas Commission on Environmental Quality has filed
524524 its recommendations relating to this Act with the governor,
525525 lieutenant governor, and speaker of the house of representatives
526526 within the required time.
527527 (d) All requirements of the constitution and laws of this
528528 state and the rules and procedures of the legislature with respect
529529 to the notice, introduction, and passage of this Act have been
530530 fulfilled and accomplished.
531531 SECTION 4. This Act takes effect immediately if it receives
532532 a vote of two-thirds of all the members elected to each house, as
533533 provided by Section 39, Article III, Texas Constitution. If this
534534 Act does not receive the vote necessary for immediate effect, this
535535 Act takes effect September 1, 2023.
