8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Chapter 45, Code of Criminal Procedure, is | |
10 | 10 | amended to read as follows: | |
11 | 11 | Art. 45.0201. APPEARANCE BY TELEPHONE OR VIDEOCONFERENCE. | |
12 | 12 | If the justice or judge determines that requiring a defendant to | |
13 | 13 | appear before the justice or judge in person for a hearing [under | |
14 | 14 | Article 45.0445 or 45.045] would impose an undue hardship on the | |
15 | 15 | defendant, the justice or judge may allow the defendant to appear by | |
16 | 16 | telephone or videoconference. | |
17 | 17 | SECTION 2. This Act takes effect on September 1, 2023. |
