77 relating to human operators of automated motor vehicles.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 545.451(4), Transportation Code, is
1010 amended to read as follows:
1111 (4) "Human operator" means a natural person in an
1212 automated motor vehicle who is capable of performing all aspects of
1313 [controls] the entire dynamic driving task.
1414 SECTION 2. Section 545.452(a), Transportation Code, is
1515 amended to read as follows:
1616 (a) Unless otherwise provided by this subchapter, the
1717 operation of automated motor vehicles, including any commercial
1818 use, and automated driving systems are governed exclusively by [:
1919 [(1)] this subchapter [; and
2020 [(2) Section 547.618].
2121 SECTION 3. Subchapter J, Chapter 545, Transportation Code,
2222 is amended by adding Section 545.4525 to read as follows:
2323 Sec. 545.4525. REQUIREMENTS OF HUMAN OPERATOR. A human
2424 operator of an automated motor vehicle must hold a valid driver's
2525 license issued under Chapter 521 or 522.
2626 SECTION 4. Section 545.454(a), Transportation Code, is
2727 amended to read as follows:
2828 (a) An automated motor vehicle may operate in this state
2929 with the automated driving system engaged only if [, regardless of
3030 whether] a human operator is physically present in the vehicle.
3131 SECTION 5. Sections 545.453 and 547.618, Transportation
3232 Code, are repealed.
3333 SECTION 6. This Act takes effect September 1, 2023.
