55 relating to the establishment of an adult education pilot program

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 19, Education Code, is amended by adding
99 Section 19.0052 to read as follows:
1010 Sec. 19.0052. ADULT EDUCATION PILOT PROGRAM. (a) The
1111 Windham School District shall establish a pilot program under which
1212 one or more nonprofit entities provide an adult education program
1313 under Subchapter G, Chapter 12, to enable persons described by
1414 Subsection (b) to successfully complete a high school program that
1515 can lead to a diploma.
1616 (b) A person confined or imprisoned in the department who is
1717 at least 26 years of age and not more than 50 years of age is
1818 eligible to enroll in an adult education program operated under the
1919 pilot program if the person:
2020 (1) has failed to complete the curriculum requirements
2121 for high school graduation;
2222 (2) has failed to perform satisfactorily on an
2323 assessment instrument required for high school graduation; or
2424 (3) has failed to earn a high school equivalency
2525 certificate.
2626 (c) The district shall enter into a memorandum of
2727 understanding with at least one nonprofit entity described by
2828 Section 12.256, Education Code, to provide an adult education
2929 program under the pilot program. The district shall require the
3030 nonprofit entity to identify each region of this state in which the
3131 entity is able to operate an adult education program under the pilot
3232 program.
3333 (d) The district, in consultation with each nonprofit
3434 entity with which the district enters into a memorandum of
3535 understanding under this section, shall identify at least three
3636 schools operated by the district that are suitable to serve as sites
3737 for the pilot program.
3838 SECTION 2. Not later than September 1, 2024, the Windham
3939 School District shall establish and implement the pilot program
4040 required by Section 19.0052, Education Code, as added by this Act.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2023.
