55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility requirements for grants under programs
88 of the Texas Commission on Environmental Quality.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 5.124(f), Water Code, is amended to read
1111 as follows:
1212 (f) A grant may be made by direct award only if:
1313 (1) the executive director determines that:
1414 (A) selection of recipients by the solicitation
1515 of proposals or applications is not feasible; and
1616 (B) awarding the grant directly is in the best
1717 interest of the state;
1818 (2) eligibility for the grant is limited to:
1919 (A) an agency or political subdivision of this
2020 state or of another state;
2121 (B) a state institution of higher learning of
2222 this state or of another state, including any part or service of the
2323 institution; [or]
2424 (C) an agency of the United States; or
2525 (D) a nonprofit organization that conducts
2626 research and field work for the same purposes as those of the grant;
2727 or
2828 (3) the grant is awarded to a person established or
2929 authorized to develop or implement a comprehensive conservation and
3030 management plan under Section 320, Federal Water Pollution Control
3131 Act (33 U.S.C. Section 1330), for a national estuary in this state.
3232 SECTION 2. This Act takes effect September 1, 2023.
