77 relating to a mobile stroke unit grant program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 773, Health and Safety Code, is amended
1010 by adding Subchapter H-1 to read as follows:
1111 SUBCHAPTER H-1. MOBILE STROKE UNIT GRANT PROGRAM
1212 Sec. 773.221. DEFINITIONS. In this subchapter:
1313 (1) "Commission" means the Health and Human Services
1414 Commission.
1515 (2) "Department" means the Department of State Health
1616 Services.
1717 (3) "Executive commissioner" means the executive
1818 commissioner of the commission.
1919 (4) "Grant program" means the mobile stroke unit grant
2020 program established under this subchapter.
2121 (5) "Mobile stroke unit" means a specialized emergency
2222 medical services vehicle that:
2323 (A) is equipped with a mobile computed tomography
2424 scanner and other necessary medical equipment and medications for
2525 diagnosing and treating an individual who suffers a stroke;
2626 (B) is staffed with personnel trained to diagnose
2727 and provide acute stroke treatment to an individual outside of a
2828 hospital setting; and
2929 (C) has a neurologist on board the vehicle or
3030 available for consultation with the vehicle's personnel through a
3131 telemedicine medical service, as defined by Section 111.001,
3232 Occupations Code.
3333 Sec. 773.222. ESTABLISHMENT AND ADMINISTRATION OF GRANT
3434 PROGRAM. The executive commissioner by rule shall establish and
3535 the commission shall administer a mobile stroke unit grant program
3636 to improve health care outcomes for individuals who suffer a stroke
3737 by providing financial assistance to stroke facilities and increase
3838 the availability of mobile stroke units in this state.
3939 Sec. 773.223. APPLICATION. A stroke facility, as defined
4040 by Section 773.202, that holds a comprehensive (Level 1) stroke
4141 designation from the department may apply to the commission to
4242 receive money under the grant program.
4343 Sec. 773.224. AWARD OF GRANTS. (a) The executive
4444 commissioner by rule shall establish eligibility criteria and a
4545 scoring system for the commission to award grants under the
4646 program.
4747 (b) The commission may award grants under the program to
4848 eligible applicants.
4949 Sec. 773.225. USE OF GRANT MONEY. A grant recipient may use
5050 money awarded under the grant program only for the recipient's
5151 capital costs associated with procuring equipment necessary to
5252 operate a mobile stroke unit, including:
5353 (1) a specialized emergency medical services vehicle;
5454 (2) a mobile computed tomography scanner;
5555 (3) medical equipment used in diagnosing or treating
5656 an individual who suffers a stroke; and
5757 (4) any other equipment the commission considers
5858 necessary or appropriate.
5959 Sec. 773.226. GRANT RECIPIENT REPORTING REQUIREMENT. A
6060 grant recipient shall annually submit to the commission a report on
6161 the recipient's use of grant money, including:
6262 (1) the health outcomes of individuals treated by the
6363 recipient's mobile stroke units; and
6464 (2) the recipient's operating expenses associated with
6565 operating mobile stroke units.
6666 Sec. 773.227. FUNDING. The commission shall award grants
6767 as provided by this subchapter from available money and any
6868 additional money appropriated for purposes of this subchapter.
6969 Sec. 773.228. GIFTS, GRANTS, AND DONATIONS. The commission
7070 may accept gifts, grants, and donations from any source that are
7171 made for the purposes of the grant program.
7272 SECTION 2. Not later than January 1, 2024, the executive
7373 commissioner of the Health and Human Services Commission shall
7474 adopt the rules necessary to implement Subchapter H-1, Chapter 773,
7575 Health and Safety Code, as added by this Act.
7676 SECTION 3. This Act takes effect September 1, 2023.
