77 relating to advanced metering and meter information networks.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 39.107, Utilities Code, is amended by
1010 amending Subsection (h) and adding Subsections (h-1) and (l) to
1111 read as follows:
1212 (h) Except as provided by Subsection (h-1), the [The]
1313 commission shall establish a nonbypassable surcharge for an
1414 electric utility or transmission and distribution utility to use to
1515 recover reasonable and necessary costs incurred in deploying
1616 advanced metering and meter information networks to residential
1717 customers and nonresidential customers other than those required by
1818 the independent system operator to have an interval data recorder
1919 meter. The commission shall ensure that the nonbypassable
2020 surcharge reflects a deployment of advanced meters that is no more
2121 than one-third of the utility's total meters over each calendar
2222 year and shall ensure that the nonbypassable surcharge does not
2323 result in the utility recovering more than its actual, fully
2424 allocated meter and meter information network costs. The expenses
2525 must be allocated to the customer classes receiving the services,
2626 based on the electric utility's most recently approved tariffs.
2727 (h-1) The surcharge established under Subsection (h) does
2828 not apply to costs incurred in the replacement or upgrading of
2929 advanced metering and meter information networks by an electric
3030 utility or transmission and distribution utility after initial
3131 deployment. An electric utility or transmission and distribution
3232 utility may request recovery of reasonable and necessary costs
3333 incurred in the replacement or upgrading of advanced metering and
3434 meter information networks through a proceeding under Section
3535 36.210 or in another ratemaking proceeding.
3636 (l) The commission by rule shall require the independent
3737 system operator for the ERCOT power region to maintain an Internet
3838 portal that allows a customer of a transmission and distribution
3939 utility receiving service in the ERCOT power region or the
4040 customer's authorized representative to access usage data from the
4141 customer's meter. The commission may not require a transmission and
4242 distribution utility to maintain an Internet portal described by
4343 this subsection.
4444 SECTION 2. Section 39.402(e), Utilities Code, is amended to
4545 read as follows:
4646 (e) Notwithstanding Subsection (a), an electric utility
4747 subject to this subchapter that elects to deploy advanced metering
4848 and meter information networks may recover reasonable and necessary
4949 costs incurred in deploying advanced metering and meter information
5050 networks. An electric utility that elects to deploy advanced
5151 metering or meter information networks is subject to commission
5252 rules adopted under Sections 39.107(h), (h-1), and (k). The
5353 commission shall ensure that any deployment plan approved under
5454 this section and any related customer surcharge:
5555 (1) are not applicable to customer accounts that
5656 receive service at transmission voltage; and
5757 (2) are consistent with commission rules related to
5858 advanced metering systems regarding:
5959 (A) customer protections;
6060 (B) data security, privacy, and ownership; and
6161 (C) options given consumers to continue to
6262 receive service through a non-advanced meter.
6363 SECTION 3. Section 39.452(k), Utilities Code, is amended to
6464 read as follows:
6565 (k) Notwithstanding Subsection (d), an electric utility
6666 subject to this subchapter that elects to deploy advanced metering
6767 and meter information networks may recover reasonable and necessary
6868 costs incurred in deploying advanced metering and meter information
6969 networks. An electric utility that elects to deploy advanced
7070 metering or meter information networks is subject to commission
7171 rules adopted under Sections 39.107(h), (h-1), and (k). The
7272 commission shall ensure that any deployment plan approved under
7373 this section and any related customer surcharge:
7474 (1) are not applicable to customer accounts that
7575 receive service at transmission voltage; and
7676 (2) are consistent with commission rules related to
7777 advanced metering systems regarding:
7878 (A) customer protections;
7979 (B) data security, privacy, and ownership; and
8080 (C) options given consumers to continue to
8181 receive service through a non-advanced meter.
8282 SECTION 4. Section 39.5021(a), Utilities Code, is amended
8383 to read as follows:
8484 (a) Notwithstanding Section 39.502, an electric utility
8585 subject to this subchapter that elects to deploy advanced metering
8686 and meter information networks may recover reasonable and necessary
8787 costs incurred in deploying advanced metering and meter information
8888 networks. An electric utility that elects to deploy advanced
8989 metering or meter information networks is subject to commission
9090 rules adopted under Sections 39.107(h), (h-1), and (k). The
9191 commission shall ensure that any deployment plan approved under
9292 this section and any related customer surcharge:
9393 (1) are not applicable to customer accounts that
9494 receive service at transmission voltage; and
9595 (2) are consistent with commission rules related to
9696 advanced metering systems regarding:
9797 (A) customer protections;
9898 (B) data security, privacy, and ownership; and
9999 (C) options given consumers to continue to
100100 receive service through a non-advanced meter.
101101 SECTION 5. Section 39.5521(a), Utilities Code, is amended
102102 to read as follows:
103103 (a) Notwithstanding Section 39.552, an electric utility
104104 subject to this subchapter that elects to deploy advanced metering
105105 and meter information networks may recover reasonable and necessary
106106 costs incurred in deploying advanced metering and meter information
107107 networks. An electric utility that elects to deploy advanced
108108 metering or meter information networks is subject to commission
109109 rules adopted under Sections 39.107(h), (h-1), and (k). The
110110 commission shall ensure that any deployment plan approved under
111111 this section and any related customer surcharge:
112112 (1) are not applicable to customer accounts that
113113 receive service at transmission voltage; and
114114 (2) are consistent with commission rules related to
115115 advanced metering systems regarding:
116116 (A) customer protections;
117117 (B) data security, privacy, and ownership; and
118118 (C) options given consumers to continue to
119119 receive service through a non-advanced meter.
120120 SECTION 6. This Act takes effect immediately if it receives
121121 a vote of two-thirds of all the members elected to each house, as
122122 provided by Section 39, Article III, Texas Constitution. If this
123123 Act does not receive the vote necessary for immediate effect, this
124124 Act takes effect September 1, 2023.
