55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of applied behavior analysis and
88 associated services through telecommunications or information
99 technology under certain public benefits programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 531.02161(b), Government Code, is
1212 amended to read as follows:
1313 (b) To the extent permitted by federal law and to the extent
1414 it is cost-effective and clinically effective, as determined by the
1515 commission, the commission shall ensure that Medicaid recipients,
1616 child health plan program enrollees, and other individuals
1717 receiving benefits under a public benefits program administered by
1818 the commission or a health and human services agency, regardless of
1919 whether receiving benefits through a managed care delivery model or
2020 another delivery model, have the option to receive services as
2121 telemedicine medical services, telehealth services, or otherwise
2222 using telecommunications or information technology, including the
2323 following services:
2424 (1) preventive health and wellness services;
2525 (2) case management services, including targeted case
2626 management services;
2727 (3) subject to Subsection (c), behavioral health
2828 services;
2929 (4) occupational, physical, and speech therapy
3030 services;
3131 (5) applied behavior analysis and associated
3232 evaluation services;
3333 (6) nutritional counseling services; and
3434 (7) [(6)] assessment services, including nursing
3535 assessments under the following Section 1915(c) waiver programs:
3636 (A) the community living assistance and support
3737 services (CLASS) waiver program;
3838 (B) the deaf-blind with multiple disabilities
3939 (DBMD) waiver program;
4040 (C) the home and community-based services (HCS)
4141 waiver program; and
4242 (D) the Texas home living (TxHmL) waiver program.
4343 SECTION 2. If before implementing any provision of this Act
4444 a state agency determines that a waiver or authorization from a
4545 federal agency is necessary for implementation of that provision,
4646 the agency affected by the provision shall request the waiver or
4747 authorization and may delay implementing that provision until the
4848 waiver or authorization is granted.
4949 SECTION 3. This Act takes effect September 1, 2023.
