8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Chapter 17, Business & Commerce Code, is amended |
---|
10 | 10 | | by adding Section 17.46a to read as follows: |

11 | 11 | | Sec. 17.46a. COUNTY ATTORNEY AUTHORITY TO FILE ACTION |
---|
12 | 12 | | REGARDING PRICE GOUGING IN A DECLARED EMERGENCY. A county attorney |
---|
13 | 13 | | has concurrent jurisdiction with the attorney general to pursue an |
---|
14 | 14 | | action under Sec. 17.46(b)(27). |
---|
15 | 15 | | SECTION 2. Section 17.46a, Business & Commerce Code, as |
---|
16 | 16 | | added by this Act, does not apply to a cause of action that accrued |
---|
17 | 17 | | before the effective date of this Act. A cause of action that |
---|
18 | 18 | | accrued before the effective date of this Act is governed by the law |
---|
19 | 19 | | applicable to the cause of action immediately before that date, and |
---|
20 | 20 | | that law is continued in effect for that purpose. |
---|
21 | 21 | | SECTION 3. This Act takes effect immediately if it receives |
---|
22 | 22 | | a vote of two-thirds of all the members elected to each house, as |
---|
23 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
24 | 24 | | Act does not receive the vote necessary for immediate effect, this |
---|
25 | 25 | | Act takes effect September 1, 2023. |
