55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to exceptions to prohibited contracts or other agreements
88 with certain foreign-owned companies in connection with critical
99 infrastructure in this state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 113.001, Business & Commerce Code, as
1212 added by Chapter 975 (S.B. 2116), Acts of the 87th Legislature,
1313 Regular Session, 2021, is amended by adding Subdivision (5) to read
1414 as follows:
1515 (5) "Utility services" means telecommunication,
1616 electric, water, or wastewater services provided to a customer, and
1717 includes:
1818 (A) demand response, load resource, net
1919 metering, and similar electric service programs; and
2020 (B) transmission voltage and distribution
2121 voltage electric services.
2222 SECTION 2. Section 113.002, Business & Commerce Code, as
2323 added by Chapter 975 (S.B. 2116), Acts of the 87th Legislature,
2424 Regular Session, 2021, is amended by adding Subsection (c) to read
2525 as follows:
2626 (c) Subsection (a) does not apply to an agreement to:
2727 (1) provide utility services to a company described by
2828 Subsection (a)(2); or
2929 (2) construct, operate, or maintain infrastructure to
3030 provide utility services to a company described by Subsection
3131 (a)(2).
3232 SECTION 3. Section 2274.0101, Government Code, is amended
3333 by adding Subdivision (6) to read as follows:
3434 (6) "Utility services" means telecommunication,
3535 electric, water, or wastewater services provided to a customer, and
3636 includes:
3737 (A) demand response, load resource, net
3838 metering, and similar electric service programs; and
3939 (B) transmission voltage and distribution
4040 voltage electric services.
4141 SECTION 4. Section 2274.0102, Government Code, is amended
4242 by adding Subsection (c) to read as follows:
4343 (c) Subsection (a) does not apply to an agreement to:
4444 (1) provide utility services to a company described by
4545 Subsection (a)(2); or
4646 (2) construct, operate, or maintain infrastructure to
4747 provide utility services to a company described by Subsection
4848 (a)(2).
4949 SECTION 5. Section 113.002(c), Business & Commerce Code, as
5050 added by this Act, and Section 2274.0102(c), Government Code, as
5151 added by this Act, apply only to a contract or agreement entered
5252 into on or after the effective date of this Act.
5353 SECTION 6. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2023.
