88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 562.003, Occupations Code, is amended to
1010 read as follows:
1111 Sec. 562.003. DISCLOSURE OF PRICE; PATIENT'S OPTION. (a) A
1212 pharmacy shall disclose the lowest cost cash price at that pharmacy
1313 for the drug or biological product prescribed to the patient.
1414 (b) If the price of a drug or biological product to a patient
1515 is lower than the amount of the patient's copayment under the
1616 patient's prescription drug insurance plan, the pharmacist shall
1717 offer the patient the option of paying for the drug or biological
1818 product at the lower price instead of paying the amount of the
1919 copayment.
2020 SECTION 2. This Act takes effect September 1, 2023.
