| 6 | 6 | | government corporations to use certain tax revenue for certain |
|---|
| 7 | 7 | | qualified projects. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 9 | 9 | | SECTION 1. Section 351.1015(a)(5), Tax Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (5) "Qualified project" means: |
|---|
| 12 | 12 | | (A) a convention center facility or venue and any |
|---|
| 13 | 13 | | related infrastructure; or |
|---|
| 14 | 14 | | (B) a multipurpose arena or venue that includes a |
|---|
| 15 | 15 | | livestock facility and is located within or adjacent to a |
|---|
| 16 | 16 | | recognized cultural district, and any related infrastructure, that |
|---|
| 17 | 17 | | is: |
|---|
| 18 | 18 | | (i) located on land owned by a municipality |
|---|
| 19 | 19 | | or by the owner of the venue; |
|---|
| 20 | 20 | | (ii) partially financed by private |
|---|
| 21 | 21 | | contributions that equal not less than 40 percent of the project |
|---|
| 22 | 22 | | costs; and |
|---|
| 23 | 23 | | (iii) related to the promotion of tourism |
|---|
| 24 | 24 | | and the convention and hotel industry. |
|---|
| 25 | 25 | | SECTION 2. Section 351.1015, Tax Code, is amended by |
|---|
| 26 | 26 | | amending Subsection (b) and adding Subsections (j) and (k) to read |
|---|
| 27 | 27 | | as follows: |
|---|
| 28 | 28 | | (b) This section applies only to a qualified project located |
|---|
| 29 | 29 | | in: |
|---|
| 30 | 30 | | (1) a municipality with a population of at least |
|---|
| 31 | 31 | | 650,000 but less than 750,000 according to the most recent federal |
|---|
| 32 | 32 | | decennial census; or |
|---|
| 33 | 33 | | (2) a municipality that contains more than 70 percent |
|---|
| 34 | 34 | | of the population of a county with a population of 1.5 million or |
|---|
| 35 | 35 | | more. |
|---|
| 36 | 36 | | (j) A local government corporation may act as a municipality |
|---|
| 37 | 37 | | under this section and is considered to be a municipality for |
|---|
| 38 | 38 | | purposes of this section. |
|---|
| 39 | 39 | | (k) For a municipality described by Subsection (b)(2), the |
|---|
| 40 | 40 | | term "qualified project" means only a convention center facility or |
|---|
| 41 | 41 | | a venue described by Section 334.001(4)(A), Local Government Code, |
|---|
| 42 | 42 | | and any related infrastructure. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2023. |
