8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Sec. 74.055 (c), Government Code, is amended to |
---|
10 | 10 | | read as follows: |

11 | 11 | | (a) Each presiding judge shall maintain a list of retired and |
---|
12 | 12 | | former judges who meet the requirements of this section. |
---|
13 | 13 | | (b) The presiding judge shall divide the list into area |
---|
14 | 14 | | specialties of criminal, civil, or domestic relations cases. A |
---|
15 | 15 | | retired or former judge may only be assigned to a case in the |
---|
16 | 16 | | judge's area of specialty. A judge may qualify for assignment in |
---|
17 | 17 | | more than one area of specialty. |
---|
18 | 18 | | (c) To be eligible to be named on the list, a retired or |
---|
19 | 19 | | former judge must: |
---|
20 | 20 | | (1) have served as an active judge for at least 96 months in a |
---|
21 | 21 | | district, statutory probate, statutory county, or appellate court, |
---|
22 | 22 | | constitutional county or justice of the peace. |
---|
23 | 23 | | SECTION 2. This act takes effect September 1, 2023. |
