| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 26.028, Water Code, is amended by adding |
|---|
| 12 | 12 | | Subsection (i) to read as follows: |
|---|
| 13 | 13 | | (i) The commission shall hold at least one public meeting on |
|---|
| 14 | 14 | | an application for an initial permit for a wastewater treatment |
|---|
| 15 | 15 | | facility in the county in which the facility is proposed to be |
|---|
| 16 | 16 | | located. |
|---|
| 17 | 17 | | SECTION 2. Section 26.028(i), Water Code, as added by this |
|---|
| 18 | 18 | | Act, applies only to an application for a permit that is submitted |
|---|
| 19 | 19 | | to the Texas Commission on Environmental Quality on or after the |
|---|
| 20 | 20 | | effective date of this Act. An application for a permit that was |
|---|
| 21 | 21 | | submitted to the Texas Commission on Environmental Quality before |
|---|
| 22 | 22 | | the effective date of this Act is governed by the law in effect at |
|---|
| 23 | 23 | | the time the application was filed, and the former law is continued |
|---|
| 24 | 24 | | in effect for that purpose. |

| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2023. |
