| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 2210, Insurance Code, is |
|---|
| 10 | 10 | | amended by adding Section 2210.016 to read as follows: |
|---|
| 11 | 11 | | Sec. 2210.016. AGENT REQUIREMENTS. (a) The association |
|---|
| 12 | 12 | | may establish requirements that an agent must comply with to offer |
|---|
| 13 | 13 | | or sell a Texas windstorm and hail insurance policy under this |
|---|
| 14 | 14 | | chapter. |
|---|
| 15 | 15 | | (b) The association may audit an agent who offers or sells |
|---|
| 16 | 16 | | Texas windstorm and hail insurance policies under this chapter to |
|---|
| 17 | 17 | | determine the agent's compliance with requirements established |
|---|
| 18 | 18 | | under Subsection (a). If the association finds that an agent is not |
|---|
| 19 | 19 | | in compliance with association requirements, the association may |
|---|
| 20 | 20 | | take appropriate action to limit or prohibit the agent from |
|---|
| 21 | 21 | | offering or selling a Texas windstorm and hail insurance policy |
|---|
| 22 | 22 | | under this chapter until the agent complies with those |
|---|
| 23 | 23 | | requirements. |
|---|
| 24 | 24 | | (c) An agent who offers or sells Texas windstorm and hail |
|---|
| 25 | 25 | | insurance policies under this chapter is not an agent of the |
|---|
| 26 | 26 | | association. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2023. |
