55 AN ACT
66 relating to the establishment of an advisory committee to study
77 housing supply and affordability.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter HH, Chapter 2306, Government Code, is
1010 amended by adding Section 2306.806 to read as follows:
1111 Sec. 2306.806. ADVISORY COMMITTEE TO STUDY HOUSING SUPPLY
1212 AND AFFORDABILITY. (a) In this section, "political subdivision"
1313 means a county or municipality.
1414 (b) An advisory committee is established to conduct a
1515 decennial study on housing supply and affordability in this state.
1616 (c) For each study conducted under this section, the
1717 advisory committee is composed of the following 15 members:
1818 (1) two state senators appointed by the lieutenant
1919 governor;
2020 (2) two state representatives appointed by the speaker
2121 of the house of representatives;
2222 (3) the director or the director's designee;
2323 (4) two individuals appointed by the speaker of the
2424 house of representatives who represent the home building industry,
2525 one of whom must represent builders of rental housing and one of
2626 whom must represent housing built for sale;
2727 (5) two individuals appointed by the lieutenant
2828 governor who represent a political subdivision or a statewide
2929 organization that represents political subdivisions;
3030 (6) two academic professionals who study housing
3131 supply constraints, one of whom is appointed by the lieutenant
3232 governor and one of whom is appointed by the speaker of the house of
3333 representatives;
3434 (7) one individual appointed by the speaker of the
3535 house of representatives who represents a trade association
3636 consisting of members who are licensed real estate sales agents;
3737 (8) one individual appointed by the lieutenant
3838 governor who represents a statewide nonprofit housing advocacy
3939 group;
4040 (9) one individual appointed by the speaker of the
4141 house of representatives who represents a trade association
4242 consisting of members who own, build, or operate extensively in the
4343 home building industry; and
4444 (10) one individual appointed by the lieutenant
4545 governor who represents a trade association consisting of members
4646 who own, build, or operate extensively, as determined by the
4747 lieutenant governor, in the apartment industry.
4848 (d) Not later than one year preceding the date on which a
4949 decennial report is required to be submitted under Subsection (j),
5050 the appropriate appointing authorities under Subsection (c) shall
5151 appoint the members to the advisory committee in the manner
5252 required by that subsection.
5353 (e) An advisory committee member serves in that position
5454 only for the study for which the member was appointed, and the
5555 member's term expires after the applicable report is submitted
5656 under Subsection (j).
5757 (f) An advisory committee member is not entitled to
5858 compensation or reimbursement for expenses incurred in carrying out
5959 advisory committee duties.
6060 (g) For each study conducted under this section, the
6161 lieutenant governor and the speaker of the house of representatives
6262 shall each designate one member appointed under Subsection (c)(1)
6363 or (c)(2), as applicable, to serve as co-chairs of the advisory
6464 committee.
6565 (h) Each advisory committee shall meet at the call of the
6666 co-chairs appointed under Subsection (g).
6767 (i) In conducting the study under this section, the advisory
6868 committee shall:
6969 (1) evaluate existing data sources and develop new
7070 data on improving housing supply and affordability;
7171 (2) evaluate the review processes of political
7272 subdivisions that permit new housing developments;
7373 (3) evaluate the rate at which political subdivisions
7474 approve new housing developments by right;
7575 (4) evaluate the timelines by which political
7676 subdivisions approve new housing developments, factoring in any
7777 pre-submission requirements;
7878 (5) evaluate impact and permitting fees for new
7979 housing developments;
8080 (6) identify the number of each particular type of new
8181 housing development, aggregated and disaggregated by the
8282 permitting political subdivision and development type, including
8383 accessory dwelling units, small-lot homes, townhomes, mobile
8484 homes, and below market rate housing;
8585 (7) identify state grants from any source that may be
8686 used to reward political subdivisions with rules that support
8787 abundant, relatively low-cost housing construction;
8888 (8) develop methods to identify and award grants to
8989 political subdivisions based on housing market outcomes or housing
9090 policies, which may require the political subdivision to:
9191 (A) demonstrate that the political subdivision
9292 permits new housing developments at a rate that is in the top half
9393 of political subdivisions in this state;
9494 (B) demonstrate that the political subdivision
9595 permits new housing developments at a rate that is in the top half
9696 of political subdivisions in this state for relatively low-cost
9797 housing, including multifamily housing, manufactured homes,
9898 townhomes on less than 4,000 square feet of land per unit, and
9999 accessory dwelling units; or
100100 (C) zone in a manner that ensures a sufficient
101101 housing supply is created based on market demand;
102102 (9) evaluate a political subdivision's use of general
103103 obligation bond proceeds to engage in affordable housing-related
104104 projects; and
105105 (10) evaluate the efficacy of the owning and operating
106106 of employee housing by political subdivisions.
107107 (j) For each study conducted under this section, the
108108 advisory committee shall prepare and submit to the legislature a
109109 written report that summarizes the results of the study conducted
110110 under this section. The report must:
111111 (1) include specific legislative and funding
112112 recommendations to improve housing supply and affordability issues
113113 in this state; and
114114 (2) recommend policy changes at the state and local
115115 level to facilitate data collection on and improve housing supply
116116 and affordability issues in this state.
117117 (k) The advisory committee may accept gifts, grants, and
118118 donations from any source to carry out the committee's duties under
119119 this section.
120120 (l) Not later than September 1, 2024, and every 10 years
121121 thereafter, the advisory committee shall submit the report required
122122 under Subsection (j).
123123 SECTION 2. As soon as practicable after the effective date
124124 of this Act, the appropriate appointing authorities shall make the
125125 first appointments to the advisory committee as required by Section
126126 2306.806(c), Government Code, as added by this Act.
127127 SECTION 3. This Act takes effect September 1, 2023.
