7 | 7 | | relating to a report regarding certain residential and |
---|
8 | 8 | | nonresidential services provided to individuals with an |
---|
9 | 9 | | intellectual or developmental disability. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. In this Act, "commission" means the Health and |
---|
12 | 12 | | Human Services Commission. |
---|
13 | 13 | | SECTION 2. (a) Not later than December 1, 2024, the |
---|
14 | 14 | | commission shall prepare and submit to the legislature a written |
---|
15 | 15 | | report regarding state and federally-funded residential and |
---|
16 | 16 | | nonresidential services provided: |
---|
17 | 17 | | (1) under the home and community-based services (HCS) |
---|
18 | 18 | | waiver program; |
---|
19 | 19 | | (2) under the Texas home living (TxHmL) waiver |
---|
20 | 20 | | program; and |
---|
21 | 21 | | (3) by intermediate care facilities licensed under |
---|
22 | 22 | | Chapter 252, Health and Safety Code. |
---|
23 | 23 | | (b) The report required under this section must: |
---|
24 | 24 | | (1) analyze the average monthly cost to the state per |
---|
25 | 25 | | person disaggregated by level of need for services provided to |
---|
26 | 26 | | individuals: |
---|
27 | 27 | | (A) residing in state-operated and privately |
---|
28 | 28 | | operated intermediate care facilities licensed under Chapter 252, |
---|
29 | 29 | | Health and Safety Code, disaggregated by facility size for |
---|
30 | 30 | | privately operated facilities; |
---|
31 | 31 | | (B) under the home and community-based services |
---|
32 | 32 | | (HCS) waiver program; and |
---|
33 | 33 | | (C) under the Texas home living (TxHmL) waiver |
---|
34 | 34 | | program; |
---|
35 | 35 | | (2) compare the severity of need for individuals |
---|
36 | 36 | | across settings; and |
---|
37 | 37 | | (3) include, based on data from the previous biennium: |
---|
38 | 38 | | (A) the total number of individuals, |
---|
39 | 39 | | disaggregated by level of need, who transitioned from |
---|
40 | 40 | | state-operated intermediate care facilities licensed under Chapter |
---|
41 | 41 | | 252, Health and Safety Code, to receiving services under the home |
---|
42 | 42 | | and community-based services (HCS) waiver program; and |
---|
43 | 43 | | (B) the average monthly cost of services under |
---|
44 | 44 | | the home and community-based services (HCS) waiver program for |
---|
45 | 45 | | individuals described by Paragraph (A). |
---|
46 | 46 | | SECTION 3. This Act expires September 1, 2025. |
---|
47 | 47 | | SECTION 4. This Act takes effect September 1, 2023. |
