55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a report regarding certain residential and
88 nonresidential services provided to individuals with an
99 intellectual or developmental disability.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. In this Act, "commission" means the Health and
1212 Human Services Commission.
1313 SECTION 2. (a) Not later than December 1, 2024, the
1414 commission shall prepare and submit to the legislature a written
1515 report regarding state and federally-funded residential and
1616 nonresidential services provided:
1717 (1) under the home and community-based services (HCS)
1818 waiver program;
1919 (2) under the Texas home living (TxHmL) waiver
2020 program; and
2121 (3) by intermediate care facilities licensed under
2222 Chapter 252, Health and Safety Code.
2323 (b) The report required under this section must:
2424 (1) analyze the average monthly cost to the state per
2525 person disaggregated by level of need for services provided to
2626 individuals:
2727 (A) residing in state-operated and privately
2828 operated intermediate care facilities licensed under Chapter 252,
2929 Health and Safety Code, disaggregated by facility size for
3030 privately operated facilities;
3131 (B) under the home and community-based services
3232 (HCS) waiver program; and
3333 (C) under the Texas home living (TxHmL) waiver
3434 program;
3535 (2) compare the severity of need for individuals
3636 across settings; and
3737 (3) include, based on data from the previous biennium:
3838 (A) the total number of individuals,
3939 disaggregated by level of need, who transitioned from
4040 state-operated intermediate care facilities licensed under Chapter
4141 252, Health and Safety Code, to receiving services under the home
4242 and community-based services (HCS) waiver program; and
4343 (B) the average monthly cost of services under
4444 the home and community-based services (HCS) waiver program for
4545 individuals described by Paragraph (A).
4646 SECTION 3. This Act expires September 1, 2025.
4747 SECTION 4. This Act takes effect September 1, 2023.
