| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39.554(f), Utilities Code, is amended to |

| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (f) Unless the commission approves an alternative method |
|---|
| 13 | 13 | | for compensating a distributed renewable generation owner for |
|---|
| 14 | 14 | | electricity generated by distributed renewable generation or a |
|---|
| 15 | 15 | | qualifying facility, for [For] a distributed renewable generation |
|---|
| 16 | 16 | | owner that chooses interconnection through a single meter under |
|---|
| 17 | 17 | | Subsection (e): |
|---|
| 18 | 18 | | (1) the amount of electricity the owner generates |
|---|
| 19 | 19 | | through distributed renewable generation or a qualifying facility |
|---|
| 20 | 20 | | for a given billing period offsets the owner's consumption for that |
|---|
| 21 | 21 | | billing period; and |
|---|
| 22 | 22 | | (2) any electricity the owner generates through |
|---|
| 23 | 23 | | distributed renewable generation or a qualifying facility that |
|---|
| 24 | 24 | | exceeds the owner's consumption for a given billing period shall be |
|---|
| 25 | 25 | | credited to the owner under Subsection (g). |

| 26 | 26 | | SECTION 2. This Act takes effect September 1, 2023. |
