66 AN ACT
77 relating to the use of green stormwater infrastructure in new state
88 buildings.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subchapter I, Chapter 2166,
1111 Government Code, is amended to read as follows:
1212 SUBCHAPTER I. ENVIRONMENTAL CONSERVATION AND PROTECTION [OF ENERGY
1313 AND WATER]
1414 SECTION 2. Subchapter I, Chapter 2166, Government Code, is
1515 amended by adding Section 2166.409 to read as follows:
1616 Sec. 2166.409. GREEN STORMWATER INFRASTRUCTURE IN NEW
1717 BUILDING CONSTRUCTION. (a) In this section, "green stormwater
1818 infrastructure" means infrastructure that absorbs and treats
1919 rainwater in order to limit erosion, habitat damage, property
2020 damage, and water pollution caused by flooding and to protect water
2121 quality, including rain gardens, bioswales, permeable pavement,
2222 green roofs and walls, and rain barrels.
2323 (b) This section applies to the construction of a new state
2424 building, including a building project otherwise exempt from this
2525 chapter under Section 2166.003.
2626 (c) The commission, or the governing body of the appropriate
2727 agency that is undertaking a building project otherwise exempt from
2828 this chapter under Section 2166.003, shall use green stormwater
2929 infrastructure in the construction of a state building.
3030 SECTION 3. This Act takes effect September 1, 2023.
