| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Subchapter I, Chapter 2166, |

| 11 | 11 | | Government Code, is amended to read as follows: |

| 12 | 12 | | SUBCHAPTER I. ENVIRONMENTAL CONSERVATION AND PROTECTION [OF ENERGY |

| 14 | 14 | | SECTION 2. Subchapter I, Chapter 2166, Government Code, is |
|---|
| 15 | 15 | | amended by adding Section 2166.409 to read as follows: |

| 16 | 16 | | Sec. 2166.409. GREEN STORMWATER INFRASTRUCTURE IN NEW |
|---|
| 17 | 17 | | BUILDING CONSTRUCTION. (a) In this section, "green stormwater |
|---|
| 18 | 18 | | infrastructure" means infrastructure that absorbs and treats |
|---|
| 19 | 19 | | rainwater in order to limit erosion, habitat damage, property |
|---|
| 20 | 20 | | damage, and water pollution caused by flooding and to protect water |
|---|
| 21 | 21 | | quality, including rain gardens, bioswales, permeable pavement, |
|---|
| 22 | 22 | | green roofs and walls, and rain barrels. |
|---|
| 23 | 23 | | (b) This section applies to the construction of a new state |
|---|
| 24 | 24 | | building, including a building project otherwise exempt from this |
|---|
| 25 | 25 | | chapter under Section 2166.003. |
|---|
| 26 | 26 | | (c) The commission, or the governing body of the appropriate |
|---|
| 27 | 27 | | agency that is undertaking a building project otherwise exempt from |
|---|
| 28 | 28 | | this chapter under Section 2166.003, shall use green stormwater |
|---|
| 29 | 29 | | infrastructure in the construction of a state building. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2023. |
|---|
