55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an adjustment of the average daily attendance of a
88 school district with a certain student attendance rate.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 48.005, Education Code, is amended by
1111 adding Subsection (a-1) to read as follows:
1212 (a-1) Notwithstanding any other adjustment to average daily
1313 attendance to which a school district may be entitled under this
1414 section, for a school year in which a district's student attendance
1515 rate is less than the average of the district's student attendance
1616 rate for the preceding three school years, the commissioner shall
1717 adjust the average daily attendance of the district by multiplying
1818 the district's average daily attendance by an amount equal to the
1919 quotient of the average of the district's student attendance rate
2020 for the preceding three school years divided by the district's
2121 student attendance rate. For purposes of this subsection:
2222 (1) the district's student attendance rate is the
2323 quotient of the sum of attendance by students in membership for
2424 purposes of average daily attendance for each day of the minimum
2525 number of days of instruction as described under Section 25.081(a)
2626 divided by the sum of the number of days of the minimum number of
2727 days of instruction for which those students are in membership; and
2828 (2) in calculating the district's student attendance
2929 rate for the preceding three school years, the commissioner shall
3030 use the three most recent preceding school years excluding any
3131 school year during which a statewide disaster declaration was
3232 issued by the governor under Chapter 418, Government Code.
3333 SECTION 2. This Act takes effect September 1, 2023.
