| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 48.005, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (a-1) to read as follows: |
|---|
| 12 | 12 | | (a-1) Notwithstanding any other adjustment to average daily |
|---|
| 13 | 13 | | attendance to which a school district may be entitled under this |
|---|
| 14 | 14 | | section, for a school year in which a district's student attendance |
|---|
| 15 | 15 | | rate is less than the average of the district's student attendance |
|---|
| 16 | 16 | | rate for the preceding three school years, the commissioner shall |
|---|
| 17 | 17 | | adjust the average daily attendance of the district by multiplying |
|---|
| 18 | 18 | | the district's average daily attendance by an amount equal to the |
|---|
| 19 | 19 | | quotient of the average of the district's student attendance rate |
|---|
| 20 | 20 | | for the preceding three school years divided by the district's |
|---|
| 21 | 21 | | student attendance rate. For purposes of this subsection: |
|---|
| 22 | 22 | | (1) the district's student attendance rate is the |
|---|
| 23 | 23 | | quotient of the sum of attendance by students in membership for |
|---|
| 24 | 24 | | purposes of average daily attendance for each day of the minimum |
|---|
| 25 | 25 | | number of days of instruction as described under Section 25.081(a) |
|---|
| 26 | 26 | | divided by the sum of the number of days of the minimum number of |
|---|
| 27 | 27 | | days of instruction for which those students are in membership; and |
|---|
| 28 | 28 | | (2) in calculating the district's student attendance |
|---|
| 29 | 29 | | rate for the preceding three school years, the commissioner shall |
|---|
| 30 | 30 | | use the three most recent preceding school years excluding any |
|---|
| 31 | 31 | | school year during which a statewide disaster declaration was |
|---|
| 32 | 32 | | issued by the governor under Chapter 418, Government Code. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2023. |
