| 10 | 10 | SECTION 1. Section 48.005, Education Code, is amended by | |
| 11 | 11 | adding Subsection (o) to read as follows: | |
| 12 | 12 | (o) Notwithstanding any other provision of this section, a | |
| 13 | 13 | school district is entitled to funding for a school year on the | |
| 14 | 14 | basis of the greater of: | |
| 15 | 15 | (1) the district's actual average daily attendance for | |
| 16 | 16 | that school year; or | |
| 17 | 17 | (2) the average of the district's average daily | |
| 18 | 18 | attendance for the preceding three school years. | |
| 19 | 19 | SECTION 2. This Act takes effect September 1, 2023. |
