| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 48.005, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (a-2) to read as follows: |
|---|
| 13 | 13 | | (a-2) Notwithstanding any other adjustment to average daily |
|---|
| 14 | 14 | | attendance to which a school district may be entitled under this |
|---|
| 15 | 15 | | section, if the percentage of educationally disadvantaged students |
|---|
| 16 | 16 | | enrolled in a school district for a school year exceeds the state |
|---|
| 17 | 17 | | average percentage of educationally disadvantaged students |
|---|
| 18 | 18 | | enrolled in school districts for that school year, the commissioner |
|---|
| 19 | 19 | | shall adjust the district's average daily attendance for that |
|---|
| 20 | 20 | | school year by multiplying the district's average daily attendance |
|---|
| 21 | 21 | | by an amount, if that amount is greater than one, equal to the |
|---|
| 22 | 22 | | quotient of the state average student attendance rate and the |
|---|
| 23 | 23 | | district's student attendance rate. For purposes of this |
|---|
| 24 | 24 | | subsection, a district's student attendance rate is the quotient of |
|---|
| 25 | 25 | | the sum of attendance by students in membership for purposes of |
|---|
| 26 | 26 | | average daily attendance for each day of the minimum number of days |
|---|
| 27 | 27 | | of instruction as described under Section 25.081(a) divided by the |
|---|
| 28 | 28 | | sum of the number of days of the minimum number of days of |
|---|
| 29 | 29 | | instruction for which those students are in membership. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2023. |
