55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an adjustment of the average daily attendance of a
88 school district with a high percentage of educationally
99 disadvantaged students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 48.005, Education Code, is amended by
1212 adding Subsection (a-2) to read as follows:
1313 (a-2) Notwithstanding any other adjustment to average daily
1414 attendance to which a school district may be entitled under this
1515 section, if the percentage of educationally disadvantaged students
1616 enrolled in a school district for a school year exceeds the state
1717 average percentage of educationally disadvantaged students
1818 enrolled in school districts for that school year, the commissioner
1919 shall adjust the district's average daily attendance for that
2020 school year by multiplying the district's average daily attendance
2121 by an amount, if that amount is greater than one, equal to the
2222 quotient of the state average student attendance rate and the
2323 district's student attendance rate. For purposes of this
2424 subsection, a district's student attendance rate is the quotient of
2525 the sum of attendance by students in membership for purposes of
2626 average daily attendance for each day of the minimum number of days
2727 of instruction as described under Section 25.081(a) divided by the
2828 sum of the number of days of the minimum number of days of
2929 instruction for which those students are in membership.
3030 SECTION 2. This Act takes effect September 1, 2023.
