| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 48.005, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (a-1) to read as follows: |
|---|
| 12 | 12 | | (a-1) Notwithstanding any other adjustment to average daily |
|---|
| 13 | 13 | | attendance to which a school district may be entitled under this |
|---|
| 14 | 14 | | section, the commissioner shall adjust the average daily attendance |
|---|
| 15 | 15 | | of a school district that has a student attendance rate of less than |
|---|
| 16 | 16 | | 93 percent for a school year by multiplying the district's average |
|---|
| 17 | 17 | | daily attendance by an amount equal to the quotient of 0.93 divided |
|---|
| 18 | 18 | | by the district's student attendance rate. For purposes of this |
|---|
| 19 | 19 | | subsection, the district's student attendance rate is the quotient |
|---|
| 20 | 20 | | of the sum of attendance by students in membership for purposes of |
|---|
| 21 | 21 | | average daily attendance for each day of the minimum number of days |
|---|
| 22 | 22 | | of instruction as described under Section 25.081(a) divided by the |
|---|
| 23 | 23 | | sum of the number of days of the minimum number of days of |
|---|
| 24 | 24 | | instruction for which those students are in membership. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
