55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the repeal of laws prohibiting abortion.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 171.206(b), Health and Safety Code, is
1010 amended to read as follows:
1111 (b) This subchapter may not be construed to:
1212 (1) authorize the initiation of a cause of action
1313 against or the prosecution of a pregnant individual [woman] on whom
1414 an abortion is performed or induced or attempted to be performed or
1515 induced in violation of this subchapter;
1616 (2) wholly or partly repeal, either expressly or by
1717 implication, any other statute that regulates or prohibits
1818 abortion[, including Chapter 6-1/2, Title 71, Revised Statutes]; or
1919 (3) restrict a political subdivision from regulating
2020 or prohibiting abortion in a manner that is at least as stringent as
2121 the laws of this state.
2222 SECTION 2. Section 171.207(b), Health and Safety Code, is
2323 amended to read as follows:
2424 (b) Subsection (a) may not be construed to:
2525 (1) legalize the conduct prohibited by this subchapter
2626 [or by Chapter 6-1/2, Title 71, Revised Statutes];
2727 (2) limit in any way or affect the availability of a
2828 remedy established by Section 171.208; or
2929 (3) limit the enforceability of any other laws that
3030 regulate or prohibit abortion.
3131 SECTION 3. The following laws are repealed:
3232 (1) Chapter 170A, Health and Safety Code; and
3333 (2) Chapter 6-1/2, Title 71, Revised Statutes.
3434 SECTION 4. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2023.
