66 AN ACT
77 relating to instruction in cardiopulmonary resuscitation and the
88 use of an automated external defibrillator in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 7.026, Education Code, is
1111 amended to read as follows:
1212 Sec. 7.026. DONATIONS FOR USE RELATED TO CARDIOPULMONARY
1313 RESUSCITATION (CPR) AND AUTOMATED EXTERNAL DEFIBRILLATOR (AED)
1414 INSTRUCTION.
1515 SECTION 2. Section 7.026(a), Education Code, is amended to
1616 read as follows:
1717 (a) The agency may accept donations, including donations of
1818 equipment, for use in providing instruction in cardiopulmonary
1919 resuscitation (CPR) and the use of an automated external
2020 defibrillator (AED) [instruction] to students. The agency:
2121 (1) shall distribute the donations to school districts
2222 for the purpose of providing CPR and AED instruction to students
2323 under Sections 28.0023 and 29.903; and
2424 (2) may use a portion of the donations to the extent
2525 necessary to pay administrative expenses related to the donations.
2626 SECTION 3. Section 28.0023, Education Code, is amended by
2727 amending Subsections (b), (c), (e), and (g) and adding Subsection
2828 (h) to read as follows:
2929 (b) The State Board of Education by rule shall require
3030 instruction in cardiopulmonary resuscitation and the use of an
3131 automated external defibrillator, for students in grades 7 through
3232 12.
3333 (c) A school district or open-enrollment charter school
3434 shall provide instruction to students in grades 7 through 12 in
3535 cardiopulmonary resuscitation and the use of an automated external
3636 defibrillator in a manner consistent with the requirements of this
3737 section and State Board of Education rules adopted under this
3838 section. The instruction may be provided as a part of any course. A
3939 student shall receive the instruction at least once before
4040 graduation.
4141 (e) Cardiopulmonary resuscitation instruction must include
4242 training in cardiopulmonary resuscitation techniques and the use of
4343 an automated external defibrillator that has been developed:
4444 (1) by the American Heart Association or the American
4545 Red Cross; or
4646 (2) using nationally recognized, evidence-based
4747 guidelines for emergency cardiovascular care and incorporating
4848 psychomotor skills to support the instruction.
4949 (g) A school district or open-enrollment charter school may
5050 use emergency medical technicians, paramedics, police officers,
5151 firefighters, representatives of the American Heart Association or
5252 the American Red Cross, teachers, other school employees, or other
5353 similarly qualified individuals to provide instruction and
5454 training under this section. Instruction provided under this
5555 section is not required to result in certification in
5656 cardiopulmonary resuscitation or the use of an automated external
5757 defibrillator. If instruction is intended to result in
5858 certification in cardiopulmonary resuscitation or the use of an
5959 automated external defibrillator, the course instructor must be
6060 authorized to provide the instruction by the American Heart
6161 Association, the American Red Cross, or a similar nationally
6262 recognized association.
6363 (h) From funds appropriated or otherwise available for the
6464 purpose, the commissioner shall develop and award grants to school
6565 districts and open-enrollment charter schools to assist the
6666 district or school in providing the instruction required by this
6767 section.
6868 SECTION 4. The heading to Section 29.903, Education Code,
6969 is amended to read as follows:
7070 Sec. 29.903. CARDIOPULMONARY RESUSCITATION (CPR) AND
7171 AUTOMATED EXTERNAL DEFIBRILLATOR (AED) INSTRUCTION; DONATIONS TO
7272 SCHOOL DISTRICTS FOR USE IN CPR AND AED INSTRUCTION.
7373 SECTION 5. Sections 29.903(a) and (c), Education Code, are
7474 amended to read as follows:
7575 (a) A school district may accept from the agency donations
7676 the agency receives under Section 7.026 for use in providing
7777 instruction to students in the principles and techniques of CPR and
7878 the use of an AED. A district may accept other donations,
7979 including donations of equipment, for use in providing the
8080 instruction.
8181 (c) A district may use resources other than those made
8282 available under Section 7.026 or this section to provide
8383 instruction to students in the principles and techniques of CPR and
8484 the use of an AED.
8585 SECTION 6. This Act applies beginning with the 2023-2024
8686 school year.
8787 SECTION 7. This Act takes effect immediately if it receives
8888 a vote of two-thirds of all the members elected to each house, as
8989 provided by Section 39, Article III, Texas Constitution. If this
9090 Act does not receive the vote necessary for immediate effect, this
9191 Act takes effect September 1, 2023.
