7	7	relating to instruction in cardiopulmonary resuscitation and the
8	8	use of an automated external defibrillator in public schools.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. The heading to Section 7.026, Education Code, is
11	11	amended to read as follows:
12	12	Sec. 7.026. DONATIONS FOR USE RELATED TO CARDIOPULMONARY
13	13	RESUSCITATION (CPR) AND AUTOMATED EXTERNAL DEFIBRILLATOR (AED)
14	14	INSTRUCTION.
15	15	SECTION 2. Section 7.026(a), Education Code, is amended to
16	16	read as follows:
17	17	(a) The agency may accept donations, including donations of
18	18	equipment, for use in providing instruction in cardiopulmonary
19	19	resuscitation (CPR) and the use of an automated external
20	20	defibrillator (AED) [instruction] to students. The agency:
21	21	(1) shall distribute the donations to school districts
22	22	for the purpose of providing CPR and AED instruction to students
23	23	under Sections 28.0023 and 29.903; and
24	24	(2) may use a portion of the donations to the extent
25	25	necessary to pay administrative expenses related to the donations.
26	26	SECTION 3. Section 28.0023, Education Code, is amended by
27	27	amending Subsections (b), (c), (e), and (g) and adding Subsection
28	28	(h) to read as follows:
29	29	(b) The State Board of Education by rule shall require
30	30	instruction in cardiopulmonary resuscitation and the use of an
31	31	automated external defibrillator, for students in grades 7 through
32	32	12.
33	33	(c) A school district or open-enrollment charter school
34	34	shall provide instruction to students in grades 7 through 12 in
35	35	cardiopulmonary resuscitation and the use of an automated external
36	36	defibrillator in a manner consistent with the requirements of this
37	37	section and State Board of Education rules adopted under this
38	38	section. The instruction may be provided as a part of any course. A
39	39	student shall receive the instruction at least once before
40	40	graduation.
41	41	(e) Cardiopulmonary resuscitation instruction must include
42	42	training in cardiopulmonary resuscitation techniques and the use of
43	43	an automated external defibrillator that has been developed:
44	44	(1) by the American Heart Association or the American
45	45	Red Cross; or
46	46	(2) using nationally recognized, evidence-based
47	47	guidelines for emergency cardiovascular care and incorporating
48	48	psychomotor skills to support the instruction.
49	49	(g) A school district or open-enrollment charter school may
50	50	use emergency medical technicians, paramedics, police officers,
51	51	firefighters, representatives of the American Heart Association or
52	52	the American Red Cross, teachers, other school employees, or other
53	53	similarly qualified individuals to provide instruction and
54	54	training under this section. Instruction provided under this
55	55	section is not required to result in certification in
56	56	cardiopulmonary resuscitation or the use of an automated external
57	57	defibrillator. If instruction is intended to result in
58	58	certification in cardiopulmonary resuscitation or the use of an
59	59	automated external defibrillator, the course instructor must be
60	60	authorized to provide the instruction by the American Heart
61	61	Association, the American Red Cross, or a similar nationally
62	62	recognized association.
63	63	(h) From funds appropriated or otherwise available for the
64	64	purpose, the commissioner shall develop and award grants to school
65	65	districts and open-enrollment charter schools to assist the
66	66	district or school in providing the instruction required by this
67	67	section.
68	68	SECTION 4. The heading to Section 29.903, Education Code,
69	69	is amended to read as follows:
70	70	Sec. 29.903. CARDIOPULMONARY RESUSCITATION (CPR) AND
71	71	AUTOMATED EXTERNAL DEFIBRILLATOR (AED) INSTRUCTION; DONATIONS TO
72	72	SCHOOL DISTRICTS FOR USE IN CPR AND AED INSTRUCTION.
73	73	SECTION 5. Sections 29.903(a) and (c), Education Code, are
74	74	amended to read as follows:
75	75	(a) A school district may accept from the agency donations
76	76	the agency receives under Section 7.026 for use in providing
77	77	instruction to students in the principles and techniques of CPR and
78	78	the use of an AED. A district may accept other donations,
79	79	including donations of equipment, for use in providing the
80	80	instruction.
81	81	(c) A district may use resources other than those made
82	82	available under Section 7.026 or this section to provide
83	83	instruction to students in the principles and techniques of CPR and
84	84	the use of an AED.
85	85	SECTION 6. This Act applies beginning with the 2023-2024
86	86	school year.
87	87	SECTION 7. This Act takes effect immediately if it receives
88	88	a vote of two-thirds of all the members elected to each house, as
89	89	provided by Section 39, Article III, Texas Constitution. If this
90	90	Act does not receive the vote necessary for immediate effect, this
91	91	Act takes effect September 1, 2023.
