66 AN ACT
77 relating to Medicaid coverage and reimbursement for functional
88 family therapy services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1111 is amended by adding Section 32.04261 to read as follows:
1212 Sec. 32.04261. REIMBURSEMENT FOR FUNCTIONAL FAMILY THERAPY
1313 SERVICES. (a) In this section:
1414 (1) "At-risk youth" means children who are at risk of
1515 involvement with the child welfare system, the criminal justice
1616 system, or the juvenile justice system.
1717 (2) "Functional family therapy" means an intensive,
1818 short-term, family-based therapeutic treatment program for at-risk
1919 youth designed to improve family dynamics, communication, and
2020 support by:
2121 (A) addressing core causes of dysfunctional
2222 behavior patterns;
2323 (B) decreasing negativity in the household; and
2424 (C) providing tools to improve parental skills
2525 and relationships.
2626 (b) The commission shall ensure that medical assistance
2727 reimbursement is provided to a provider who provides functional
2828 family therapy services to a recipient under the medical assistance
2929 program.
3030 SECTION 2. If before implementing any provision of this Act
3131 a state agency determines that a waiver or authorization from a
3232 federal agency is necessary for implementation of that provision,
3333 the agency affected by the provision shall request the waiver or
3434 authorization and may delay implementing that provision until the
3535 waiver or authorization is granted.
3636 SECTION 3. This Act takes effect September 1, 2023.
